The text messages will all be "OK see you soon, love you xxxx" How funny would it be if they unlocked it and all they got was lovey dovey messages to the lads girlfriend/wife/whatever?
I interpreted it as the FBI first asked them nicely off the record and when they refused to help they went ahead and made it public in an attempt to embarrass Apple into doing it. Either way I think Apple are entitled to stick to their guns, it's an interesting debate though. If they knew for sure there were details of an upcoming terrorist attack on there I'd say that Apple should do it but as Marcus says it's more likely to be the usual nonsense you and the Mrs say to each other.
It could be, but most court cases are open source information, a judge ordering apple to unlock a phone for the FBI was never going to go under the radar. Of course, apple could get around this by agreeing to try to develop a program to unlock the phone, but never actually try... just say they have and they failed.
