I can see why it sounds as if it ought to be relevant but even if she did that every night it is quite possible that she was raped by some men and not others. The only issue is whether they believed she consented and logically that can't depend on history they had no knowledge of.

Wouldn't previous similar encounters that aren't disputed suggest that Evans did believe that she'd consented, though?
The other guys believe that she consented and so did she, despite her memory loss during at least one of those instances.
It does seem to be rather a slippery slope, but I can see why it was allowed in this case.

If there had been another incident where someone had walked in on her and a friend having sex I can see why that might be relevant. But the whole reason this sort of info is usually excluded is that circumstances are different.

The similarities were seen to be relevant, though. They matched Evans version of events, which backs his claim, in my opinion.

2. In relation to that claim, he asserted that the girl had asked him to give her sex doggy style, and that during intercourse she shouted "**** me harder"
3. The jury did not believe this, and did not believe that the girl had given consent
4. Furthermore, it was held that as the defendant did not remember the encounter with evans, it was beyond reasonabke doubt that she did not consent
5. It was established in the retrial that : a) on other occassions around the same time, she went home with other men from the same bar, and did not remember the sexual enounter afterwards b) that she asked both those other men for doggie style sex (which is not unusual) and for them to **** her harder (which - notwithstanding what porn films woukd have us believe - is unusual).


The additional evidence demonstrated that it was not beyond reasonabke doubt that the defendant was telling the truth. The fact that he didnt know at the time that that is what the girl normally does, has no relevance whatsoever.

The voting public put them in the bottom 2 I believe. BBC employees vote them off. Don't watch it, but there could be a case if the 1 voted off wasn't the worse of the 2 (assuming the other was white). It does unfortunately give a lie to the assertion that the general public are no longer racist though. It seems to me whenever there is a vote, the black candidate is disadvantaged. Be it X Factor, the Voice, Big Brother etc...(I'm an occasional watcher of some by the way, so my argument may not stack up with more diligent viewing).

When I read about the first elimination, something struck me as odd: as one of the contestants couldn't perform in the dance-off, they automatically eliminated the other one.
