I thought that the ref was in control of the game, if they do see it at the time but take no action, retrospective action cant be taken. But something has to be done to help referrees.

Welling United to appeal Sahr Kabba feigning injury charge
Welling will appeal after striker Sahr Kabba was charged by the Football Association with feigning injury.
The charge relates to an incident in Saturday's 1-1 draw with Tranmere, when Rovers' Richie Sutton was sent off for an off-the-ball clash with Kabba.
"Reviewing the video footage, there definitely is contact between the defender and Kabba," Wings boss Loui Fazakerley told BBC Radio Kent.
"The defender tried to 'do him'. We are going to be making an appeal."
Sutton was originally banned for three matches but the 29-year-old defender has successfully appealed his suspension.
The FA charged Kabba with "allegedly exaggerating or feigning an injury which directly led to an opponent being dismissed" on Wednesday. The rule is new for this season.
Fazakerley thinks the FA are looking to make an example of the introduction of the rule.
"I think because it is a new rule, they want a chance to implement it and show they are serious about it," he said.
"Players feigning injury is very unsportsmanlike. I think the FA are doing the right thing about trying to clamp down on it."
Fazakerley believes there is enough video evidence to clear Kabba of the charge.
"There was body-on-body contact and that's what caused Kabba to go down," he said.
"While the elbow hasn't made contact, he has made contact with his body. It comes down to the appeal."

In the short term, yes, but that's unavoidable, I reckon. I'm optimistically hoping this might actually become an effective deterrent.
Oh aye, I agree.
It would have to be something pretty radical, in football terms, for the cheated team to benefit in any way.
Maybe if you dive to win a pk or get someone sent off your team gets the punishment instead.
