    i'm not sure on the legalities but actually his behaviour could have given Newcastle a golden opportunity to get out of that contract. Sacking a manager for poor performance incurs compensation but sacking a manager for gross misconduct (which they could probably say that was) would/could be free, i think

    Indeed. If that doesn't construe gross misconduct, then it's hard to imagine what would! Maybe Pardew knows a little too much about some of Fat Mike's dealings?...

    It had crossed my mind too, at what point does instant dismissal kick in, its a very strange contract to not have all events covered for both parties...though our Levy does miss out release clauses! so who knows whats in it.

    It has long been the case in employment law that gross misconduct is an offence punishable by instant dismissal. What construes gross misconduct, which could vary depending on type of employment, and who the arbiter of that decision would be, is less clear.

    Headbutting someone at work is almost always going to go down as gross misconduct though, surely? <laugh>
    Barring the odd MMA fighter or kickboxer, I can't really think of many jobs where you'd get away with that.

    Maybe, but nutting one of your own colleagues is usually considered pretty poor form!...not sure of doing it to an employee of a rival company would be better or worse....

    Forest's Billy Davies has been found guilty of using abusive and/or insulting words and/or behaviour towards the match referee and touching him intentionally.
    He's been given a five match touchline ban.
    Doesn't bode well for Pardew, really.

  10. Nutting your boss is the worst thing one could do (from an Employment Law perspective), nutting a fellow employee comes in at a very close second. Nutting a rival could, in some circles, be seen as good marketing.

    It's always dependent on who did it too. Companies can dismiss them for that but you can bet if the person is considered irreplaceable that they won't get sacked.

    Chelsea are a good example. Cole brought an air rifle to training and shot someone and all he got was a fine but when a youth player let off a smoke bomb they sacked him.

    Yes true. In a way, Pardew is worse, he's supposed to be the boss. Interesting that they did give him a formal warning.

    Going forward, how can any advice from him on the subject be taken seriously, its part of his job to coach discipline and keep a lid on his own volatile characters, Tiote for example. Whatever he says from here, you know "who are you to talk" is crossing everyones mind, and its not an isolated incident, he has previous lesser spats, its rather undermining.

    I couldn't take Pardew seriously, anyway! So, for nutting an opposition player he gets a warning. Be interesting to find out what he has to do to get himself fired - shoot one of them, maybe?
