Well not in a legal sense as there has to be some form of intent, but by FA rule 3a standards (and the standards Suarez was judged by) they said there didn't have to be intent - the fact that Suarez had entered an insult contest (unarguably started by Evra) and had mentioned skin colour was enough for the FA. So, did Rio not endorse a tweet that insulted Cole and that made reference to skin colour?
Actually I'm suggesting the opposite. I think that if Suarez had told the truth from the start then he would probably have gotten a lesser punishment. As it is, he made initial statements and comments in the hearings which he later contradicted, which basically meant the DC didn't trust a word he said. I doubt the FA would have doubled the standard punishment from four to eight games had he been upfront about what happened right from the start, rather than claiming he didn't say what Kuyt, Commoli and Dalglish said he did, and claiming he was trying to be conciliatory.
Besides which, the Terry court case has just clearly demonstrated that you can get away with something if you and your colleagues all stick to the same story, truthful or not. More than one criminal has gotten away with it because they had a consistent story backed up by witnesses. Nothing to do with morality, just common sense.

Let me sum this up for you.
John Terry is an absolute cock who got away with calling someone a black **** because the court couldnt prove that he used it in a racially derogative way.
But the FA will charge him and he will likely get a small fine and a ban for a few matches.
Rio Ferdinand is a cock who is agreeing that Ashley Cole is betraying Black people because he defended a white guy in a case against a black person and he should have automatically been on Antons side because Anton is black like him. Which is also racist. Anyone who cannot see that is suffering from a level of spastication greater than that I thought ever was possible. It wont go to court because it was a silly comment probably made in jest, and Rio being the tard that he is probably didnt even understand what he was saying. But the FA will probably still hit him with a ban because at the end of the day the term choc ice implies that black people should act different to white people and that black people should always stick together regardless of the facts purely because they are black.
