If they did expel us we should head to Wembley anyway. See how they cope with 120,000 people instead of 85,000 and 3 sets of fans.
 
I should also add to the post above that whether we benefitted from it or not, it also has no bearing. It's all about our boy observing their training. They would probably want to know if he was sent there by the club or did it of his own volition. Whatever it was wouldn't get us off the hook as he would be a SFC employee but it might have some affect on the level of punishment.
If he wasn't sent by someone more senior at the club then they should probably have sacked him by now. That way they can legitimately say to the EFL that we've done everything we can to address the matter - this was a rogue individual, we're shocked at his behaviour and he's been dismissed. Maybe throw in some training for all staff on ethics and the EFL rulebook as well.

Agree with both this and your last post. The public land thing (though is a hotel really public land anyway?) and level of benefit is irrelevant to the EFL charge.

The latter would come into play for any potential civil action taken by Boro though.
There are public footpaths that run across private land so it's possible.

I think if the EFL remove us from the Play Off Final, the legal challenge would be immense. Thye could literally be sued for >£100m, likely far more than that.

I'd also go further by suggesting every EPL team also would sue them from the likelihood of 6 points guarantee and a handsome goal difference advantage they will all miss out on...

There is a long post on Saintsweb with someone setting out what our legal challenges might be

I’m sure Boro will argue they are the “wronged” party and they could also sue for £200m. Difference is we’ve beaten them and actually qualified for the final. They can’t prove the spying did enough to change the result. If anything there is an argument that it fired them up and that we might have won the first game had this not come out. Sounds rubbish but it’s just as difficult to prove for or against as any claim that they would have won

I’m no lawyer but the BBC article says we can’t appeal the ruling after the initial appeal.

So if we get a fine then Boro appeal that and it gets upped we have to accept the appeal decision.

It was kind of a kind of a joke that the prem teams will sue us if we don’t go up as we would be an easy 6 points for each of them.

I'm quite happy that it's Friday, rather than tomorrow as originally announced, when they go on sale. Tomorrow would have been quite difficult for me.

I wonder how prices will compare to the City game.

I wasn’t aware of that, although it sounds unlikely we couldn’t appeal otherwise we may just sell have Boro on the panel.
 
Surely EFL get the fine money not Boro.
Depends on what the panel decide I guess. Doesn’t sound like we really know what they can consider by way of range of punishments

But technically the hearing is us vs EFL. Not Boro directly. Which in theory would mean Boro can’t appeal the verdict either. Unless I’ve misunderstood

Yes

The first hearing needs to take place sooner rather than later, as all parties categorised by the independent disciplinary commission as holding an interest must have the right of appeal - and that could include Middlesbrough.

Any ruling from an appeal is considered final. EFL rules do not permit the case to be taken to the Court of Arbitration for Sport.
 
Yeah either party can appeal the initial decision. Just whatever the decision is after the appeal can’t be appealed. Seems likely someone will appeal the first decision
