Saints expelled from Play Offs by EFL

Seems to me some precedent has been set already by other situations.

Bielsa - he admitted they did it to pretty much every team they played, I have not checked but multiple teams were watched before he got caught and a new rule made up. He took the punishment himself and paid £200k and there was no points deduction or anything like that. Leeds united were not punished.

Eric Cantona kung fu kick - Cantona himself was banned, did some community service and paid a fine. Manchester United were not punished(other than losing Cantona, rightly so).

Ivan Toney betting scandal - Toney was banned and fined. Brentford did not get punished(other than losing Toney, rightly so).

Rio Ferdinand missed drug test - Banned, Manchester United not punished etc.

Joey Barton betting scandal - Banned, fined. Burnley did not get punished.

Barnet boss Dean Brennan verbally abusing the female ref - Banned, fined. Barnet did not get punished.


So it seems to me there is clearly a precedent. Someone gets banned and fined but the club does not get punished. It's a can of worms if anything different happens this time, especially when it is a lesser crime than these!
More importantly the Boro fans seem to think they should be rewarded rather than Southampton punished. Which is nonsense
 
I can't stop reading the Boro forum at the moment. It's like when your mate finally splits up with his crazy Mrs and you still get to read her absolutely mental outbursts on Facebook. I thought the skates were bad enough with their Portsmyths, but these lot are a whole new level of special.

If we win tomorrow and aren't kicked out the melt down will be glorious. I fully expect them to try and get Tonda to the Hague

The only problem with this line of argument is the more obviously relevant precedent that was set in the 2024 Women's Olympic tournament when Canada used a drone to spy on the New Zealand team's training sessions. That ended up with FIFA deducting 6 points from them and three members of their staff (including the head coach) were banned from all football for a year.

I'm not saying that's what's going to happen in our case but it's almost certainly more relevant than what Cantona did.

The only problem with this line of argument is the more obviously relevant precedent that was set in the 2024 Women's Olympic tournament when Canada used a drone to spy on the New Zealand team's training sessions. That ended up with FIFA deducting 6 points from them and three members of their staff (including the head coach) were banned from all football for a year.

I'm not saying that's what's going to happen in our case but it's almost certainly more relevant than what Cantona did.

Unless there is evidence that the intern was sent by someone else (which I’m sure there is, how quickly that’s been deleted is the question) then this is what seems likely to me. A fine, points deduction for next season and the intern being banned from football for a year. Hopefully for the interns sake he gets a full years pay and a job when the ban is over from Saints for keeping his mouth shut

I could see them doing a suspended points deduction but, as you say, it's all about the detail and none of us know the details.

You'd hope the intern gets looked after. Goztepe is a multi-sports club so perhaps someone will quietly tell him that İzmir is a wonderful place to live and how interesting handball can be.

The difference is only Biesla's actions benefitted the team/club, and the club could not be suspected of being behind any of the others.

Bielsa was doing it all season, he admitted to that. This, as far as we know is an isolated incident in a public place, hardly crime of the century!

But what happens when, on instruction of Steve Gibson, the police raid both St Mary's and Staplewood and seize all electronic devices to be forensically examined? It could all fall apart.

They would request phone and email records I suspect to clear the club from instructing him to do it.

Whether legally we would have to do it is another matter that I don’t know. If we have nothing to hide then we’d probably agree to it. If we don’t it probably confirms that he was told to do it but, as always with legal cases, it’s not what you know it’s what you can prove

FIFA and EFL are completely different though. So is using a drone in presumably an area they couldn't get to(hence the drone) Vs using a mobile phone on a public right of way!

We wouldn't be under any obligation to turn anything over but they could probably throw a non-cooperation charge at us if we didn't.

On your last line while that saying is correct the threshold in this matter will be on the balance of probability, it won't require an extremely high burden of proof.

Depends on the punishment. If they can prove it without any doubt then the punishment could be a lot more severe. If there is any dispute and the punishment is severe then Saints will appeal.

As I said earlier I think the EFL will want this done quickly so will give a punishment that Saints are happy to just accept and not appeal. If we win tomorrow then that punishment is not going to be enough for Boro so will rumble on. If they win tomorrow then they won’t care as much

Yeah agree with that, the EFL will desperately be hoping Boro win for that reason.
