No Thai, what i am saying is that it was pointless WBA appealing against the charge because the case was already prejudiced because of the media and Mark Halsey saying what he did. Accident or not Tamas would not have received a fair trial because of all of this. It is my opinion that there was still enough doubt over this because of the angle of the players to one another. Finally, Unless there is a Budgie out there with the proven ability to be able to read somebodies mind nobody will ever know if there was intent or not, not me,superman or even you Thai. Unless of course you have this such ability?
I said all along proving intent was not going to be easy but to me and god knows how many other people in the UK, it looked like it was. His feet barely left the ground (if at all), so why was there a need to raise his elbow and swing it? If he wanted to get passed Vaughan he could have tried without doing what he did. I shall not bother on this thread anymore Guru because I know I will just be banging my head against a proverbial brick wall. I really do hope a very similar incident happens in one of your games soon and see how you feel about it at that time. I believe, as you will about us, your judgement is cloudy because of your desire to see us **** it up big time this season.
well its not easy to judge from a tv clip and i sort of agree with guru that he wouldn't have received a fair hearing, but having been there to witness it and see it close up, there was absolutely no way it was an accident so he deserves his ban. its just come too late for us unfortunately...
Intent is looked at as standard in a court of law. Act + Intention = Crime and it doesn't necessarily have to be fully intentional. So I can't see why it can't be proven in this case. If this wasn't a football match, Tamas could potentially be prosecuted for ABH by assault. This will obviously not go to a court of law as it was during a football match which is orgasnised by governing body, the FA. So, intent can definitely be proved.
But Wonky, If this was a court of law this hearing would be thrown out straight away due to the media coverage + what Halsey is alledged to have said after, So Tamas would not have had a fair hearing. Don't you agree? From my perspective of the incident looking at it again from just TV pictures, yes Tamas has his elbow raised and i can see where the image of intent can be obtained, but by the angles of the 2 players i could also see that Tamas is trying block vaughans run to get in front from his left, so vaughan checks to go to his right which is when he gets caught. so in my view, because vaughan done that change of direction and Tamas had to change his body direction to composate there is enough to doubt what his intentions are. Hope this clears up why i feel the need make the case for the defence.
The media would usually respect that if it was a trial and it's not like it's all over the news. This sort of thing happens all the time, I don't think it's enough to affect it. You're also suggesting that it was face to elbow, which it clearly wasn't, rather than elbow to face. Why are you, an 1p5wich fan, so interested in something involving your rivals anyway?
Firstly, I'm not suggesting it was face to elbow, what is said is vaughan changed direction to which Tamas did to compensate which was the contributing factor in him catching him with his elbow, so this could be percieved as accidental. Secondly, why am i so interested. I am interested as a football fan, I am interested in your fortunes because i would like to see how my team could cope if we were lucky enough to get there. From the sounds of your last line, which i noticed you included the side splitting 1p5wich tag (strange how you budgies can percieve history as applicable whenever you feel its ok, yet mostly the line from you lot is history doesn't count for nothing) suggests i have probably hit on a very valid point, which you can't argue against.
guru has every right to comment, i just think in this case he knows deep down that it was a very serious incident which was deliberate. no change of direction or blocking of runs can amount to anything - the guy checked for where vaughan was and really launched his elbow at him with venom. anyone that thinks it wasn't intentional is only going by what they've seen on tv slowed down - for those of us that were there the reality is clear. should have been a red card and a penalty. end of. lets move on...
