.....against the FA for refusing to overturn Andy Carroll's red card last saturday..... You couldn't make it up....
If West Spam went through with this and won, it could make a huge difference to FA appeals in the future
Does anyone know what grounds this would be based on? Perhaps we should take legal advise on whether we could sue them over granting Bradley johnson's appeal!
its a joke, they get every review wrong, two players go head to head and they rescind johnsons eve though he faked getting butted yet again but not remys. the appeals panel arent even from the fa.
If they are relegated as a result of that one decision. They've built a house of cards and need a get out...
This could set a very dangerous precedent. Yes we all know that the FA disciplinary panel is far from perfect, we ourselves have been victims, but that is the system and all clubs have to accept it or the whole system will collapse. What happens if Carroll serves his ban but then a court overturns it, will WH seek compensation, ask for the matches to be replayed (presumably only if they lose). I thought that there was a Fifa rule that prevented this kind of thing, if there isn't there should be.
hopefully this will lead to proper people being on the appeals panel, I still can't believe they didn't rescind derry's red card when even the "there was contact" lot from MOTD said it wasnt a red. then there was Barton's red for literally nothing against Norwich, they should be made to explain their findings.
If the result of this is a better appeals process, then it's worth it. There have been far too many instances where people have been sent off for no reason whatsoever (in our case Barton v Norwich and Derry v Man Utd are the obvious ones). Remy should never have been sent off, and certainly not confirmed on appeal. Carroll barely touched Flores, certainly not deliberately because he hadn't even looked to see where Flores was, his hand brushed the top of his head and he goes down clutching his face and crying like a baby? Pitiful. I hope it doesn't result in a raft of legal challenges, but it SHOULD result in an appeals process where an independent three man board look at footage of the event alongside the FIFA and FA rules concerning when red cards are appropriate, and if there's any doubt, the original match officials should have to explain why they gave the decision. Whether this board sits in all cases, or only where teams fail to get an original appeal overthrown and want to pursue it further, is up for debale. But it's clear the FA board are not following the game's rules when they make their arbitrary decisions.
No doubt Flores performed a dramatic "Spanish swan dive/roll", but Carroll's arm definitely swung around with the intent of connecting with some part of Flores, and lucky he was going down already, otherwise it would have been an arm in the face/head.
This is a picture of West Ham's Legal Red Dress as worn by Chairman's daughter (and boss of Ann Summers), Jacqueline Gold. It is definitely a legal dress, although you can't see her briefs. please log in to view this image
still, brushing his hair isnt violent conduct. id love to see the rule they got remy for, it certainly wasnt violent conduct.
It's the "intent" that they will use to back-up their decision. Carroll does swing his arm back but it's more of a "get off me" action to Flores who had his arms around his neck as he went up for the header and was basically hanging off his back. I've got to agree with Willy, I hope they go through with their threats and it causes massive changes in the whole process because, at the moment, it's a joke..............but then the whole FA is a joke. Unfortunately, I can't see any changes coming from it or the FA/Premier League changing their stance on the red card. Perhaps if it wasn't their "darling" referee it might have been a different story. However, being Howard Webb, he can't be seen as making another mistake (plenty this season alone) with him being their representative at the world cup in a few months time.
