She said she had no confidence in judicial process of going forward at this point. She felt she couldnt carry on if she no longer had the confidence. She had confidence in the system up to the judicial review point but when the judge said they had no case, she no longer had confidence in the system as the chances of winning will be very slim. Le Fevre said in other words you have full confidence in the judicial process but you just dont think you will win. Radice replied yes. Le Fevre replied so the judicial process is fine and democracy is doing what it should so the system is right meaning you didnt really resign due to confidence in the judicial process is but resigned as you didnt have confidence you would win. Radice didnt respond to that. Le Fevre went on saying the judge made a quick decision to dismiss their case doing it within a day. Radice said their legal team believe the judge made a wrong turn in his judgement. Le Fevre asked Radice as evrything was done correctly and she thinks they will lose, will she advice TRASH to give up. She replied TRASH wants to keep all their options open for as long as possible. Le Fevre said its costing a lot of money doing that which Radice said its not at the moment as nothing is happening. Le Fevre then pointed out its costing Rovers a lot of money which she denies is the case. She went on saying she and the locals are still very worried over the impacts of sainsburys what it will do to Glos Rd and the traffic/pollution. Le Fevre went on that people are entitled to opinions but when you take it to a judicial review which gets turned down by the judge and then you appeal that the judge was wrong which got turned down, its gone down the correct and proper process, isnt it time now to give up. She said by resigning from TRASH answers that and she wont give advice to TRASH to give up as they are perfectly capable of making their own decisions. TRASH / Le Fevre basically went: Le Fevre asked if TRASH will follow the lead by Radice and give up. TRASH said no. They dont agree that the appeal they put in on Wednesday against the judges decision at the judicial review should go back to the same judge to make a decision on this new appeal and that was rejected very quickly - too quickly. They said its a funny part of the process which they dont understand but do accept. However their legal team believe there is still a good grounds of appeal. They think the judge made the original decision too fast (used 1 day at the JR instead of the 2 days allocated) and the same judge making his decision to refuse appeal within the same day as the appeal was made on Wednesday. These decisions by the judge was made too fast without thinking and didnt appreciate there was a lot at stake here. Le Fevre then said both sides rehearsed their cases before the judicial review and so would have the judge and he made the decision very quickly that the council made the right decision and made no mistakes, so surely that should be the end of the matter. TRASH said their legal team were disappointed in the fast decision and analysed the judges detailed decision and believe there is good grounds to appeal. Le Fevre asked how much is this all costing. TRASH went quiet and then said they were not in a position to comment on that. Le Fevre asked why not and TRASH said because they are not. Le Fevre asked who is in a position to tell us how much how much this will cost you and the tax payer. TRASH replied thats for ourselves to know at the moment. TRASH was then asked where was the money coming from and TRASH said they refuse to comment on that and its with the legal team. TRASH was then asked who was paying the lawyers. TRASH then laughed (sounded frustrated) and then replied saying if they go to court of appeal then there will be costs and the lawyers will be paid. They confirmed it will cost a lot of money to go to court of appeal but have the funds to do so. Le Fevre asked do they have private donors or sponsors which TRASH refused to comment on. Le Fevre said you claim to represent the traders and the locals so why cant they be transparent how its working. TRASH said at this early time in the process its not the right time to give the info out on what is being asked. Le Fevre said its not the early stage, its at the tail end as there is appeal after appeal after appeal. TRASH didnt reply to that but said we have a few more day to look at it and its in the hands of the legal team. They have no more need to comment at this time as its now entirely a legal process but no decision has yet been made. TRASH then ended on rant. Was funny. Have a list and hear if for yourself. I'm a little suspicious that TRASH have a wealthy backer(s). It will cost thousands to go to the Court of Appeal and even more to take it to the Supreme Court. They've also been rather coy about where they're getting their funds from. I smell a rat. It may live in Guernsey.
In theory TRASH have until tomorrow evening to lodge their second appeal. If they do I'm going to buy a gun.
they have until 4pm today. any later will not be accepted. i expect either they will concede like radice did or we will hear at 3:50pm that they will appear waiting for the last minute possible.
