The article only goes to further embarrass both GFC & McCammon. How did Scally think that he could enforce additions to his copy of McC's contract regarding a pay cut following relegation. To save a few quid by not having a proper draft written up for both parties, it will cost the club thousands.
McC's claim of racism, not having been made within the statutory three month period, does nothing for him. It may show that he is playing the race card - purely because the colour of his skin gives him that 'opportunity'. The circumstances of the abuse of this 'advantage' seriously undermines genuine racism complaints - however, we all know that if you throw enough excrement it will stick. In these politically correct & enlightened days nobody can just ignore an allegation of racism - even if made outside the statute of limitations. Racism is such an embarrassment if proven, that, despite McCammon's late claim, the Club needed to immediately refer the matter to an independent investigator.
It does appear that the club has been guilty of poor administration in more than one aspect of the matter. Unfortunately when you throw in a 'sensational' allegation of racism - which, in itself has not been proven, that allegation gains a lot of credence because of the failings in other details - which are mainly secretarial - but a lot of gullible people will believe any newspaper headline.

Still managing to work his way into the news yet again. This time the PFA has issued a public apology to him because they did not support his accusations. In the article it states that he filed the court case against us "for not investigating the accusations". I could have sworn he created the case accusing Hess of being racist unless I'm mistaken?

But on the bright side at least it says he's retired from football now.

It speaks volumes about the ( lack of) case for racial discrimination that McCammon had (not) when his own union didn't want to know - but they should have known better - this is GFC - not exactly unknown for clerical errors.
Anyway - I might bring a civil action against McC - my Human Rights have been greatly infringed - I thought I was going to watch a footballer ? 5 goals in three seasons !! - that's why Gillinghan FC got rid of him

alwaysright - If we are to believe anything the media ever writes, one of the parts in all this that absolutely astounds me is the process issues, quote:

'The case centred on the failure to adhere to the process, laid out in the Equality and Human Rights Commission's code of practice, rather than on the reasons for McCammon making his claim of discrimination'

Now I think I told you on our away trips what I used to do for a living and it is just so simple to follow basic management procedures, I do not even need a lawyer to guide me, at worst maybe HR just to dot a few i's and cross a few t's. From my experience failure to follow employee issues meticulously can have consequences.

I know everything is easy said with hindsight but some of the stuff I read such as this just makes me cringe in disbelief if there is any truth in the publications. I suppose the question I would raise is what training do any football managers have in regards to the minimum Discipline and Grievance process and procedures?

Speaking in general, one of the let off's for most employers is that employee's tend to be rather lazy in following up any grievance or maybe might not quite understand what their precise grievance may actually be in affect of gaining a positive decision. However, those that do persist and clue themselves up on understanding, can give their employer's a tough ride if the employer has not been meticulous in today's working environment.

In any other business his level of performance within his role in the company would have led to him being dismissed, but most companies would ensure that all correct procedures were followed in order to avoid the tribunal, unfortunately clerical error at football club leads to procedures not being correctly followed is not as eye catching as anything to do with alleged racism
