Karen Murphy had to pay nearly £8,000 in fines and costs for using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening. But she took her case to the European Court of Justice (ECJ). It found partly in her favour, but returned the case to the High Court in London for a final ruling. The High Court had originally sent the case to the European courts for advice on numerous points of law. The ECJ said last autumn that national laws which prohibit the import, sale or use of foreign decoder cards were contrary to the freedom to provide services. The European judges also said the Premier League could not claim copyright over Premier League matches as they could not be considered to be an author's own "intellectual creation" and, therefore, to be "works" for the purposes of EU copyright law. But it did offer some comfort for the Premier League, which receives vast sums through its exclusive broadcasting deals with Sky and ESPN. The European court said that while live matches were not protected by copyright, any surrounding media, such as any opening video sequence, the Premier League anthem, pre-recorded films showing highlights of recent Premier League matches and various graphics, were "works" protected by copyright. To use any of these extra parts associated for a broadcast, a pub would need the permission of the Premier League. The case is being closely watched as it could trigger a major shake-up in the way football TV rights are sold, and potentially pave the way to cheaper viewing of foreign broadcasts for fans of top-flight English games"
I hope she gets off too - Sky started pricing themselves out of the pub market and then get upset about their own downfall and start trying to blame the rest of the universe. The fact that they've been found to have no case but are trying to attack individuals makes them all the more deplorable. The pub owners are having a tough time of it - this does not do anything for Sky's PR. If they want to get the compensation for the lost revenue through their slimy lawyers and their pissy little loopholes then go after Nova Sports etc directly. Even then, I'd hope that the compensation is related to the additional revenue the rival providers make from showing the logos and old footage rather than the football (not that that would be very tangible but it should be pretty minimal). They really are c**ts.
Glad she did too, I watch every game I cant get to online. I get to see all the games and dont give sky a penny, its a win win.
Enjoy it all free while you can as the idiots who thought that streaming technology wouldn't catch on are now on the case. I have a mac mini connected to a TV and the quality is good enough on internet streams. I also have a hooky Sky ID for Sky go **** the POLICE
I'm glad she won. It seems very harsh to fine a landlady £8000 for something they are blatantly doing in every other pub on the continent. My local here makes no secret of showing games via random internet streams.
Im very pleased she won. Any victory for common sense is good for me....plus its another kick in the (a) wallet or (b) balls or (c) both for Murdock. Now, where can I find one of his phone hackers or a teenager to help with me new mobile......
