    He wouldn't have been arrested if he hadn't been drinking and driving. When that light comes on, you are arrested, no ifs and no buts.

    I hope they charge him with careless driving, or some other road traffic offensive. Falling asleep at the wheel is no excuse.

    Where have you seen he wasn't tested at the scene? every source I've seen including the bbc says he was, and yes you will be arrested on suspicion after failing a roadside test. Thats all the Police can do, you're only on suspicion until an Intoxiometer test at the stn. If you fail that, you are 'offered' a blood test. Here's the law...

    Quite simply a straight answer, what are you trying to achieve telling me in the first instance the story was on the bbc, when it appears you haven't read it, otherwise why do you later insist he wasn't breathalysed at the scene? As I've already asked, where have you seen he wasn't tested roadside, because I haven't.

    I hate to be pedantic, but it actually says that a 43-year-old man was breath tested, not Paul Merson.
    It'd be a bit of a coincidence if it wasn't him, though!

    Ensil - You've been proved wrong on the law and the fact he was breathalysed at the scene till you show otherwise, I've asked politely, but all you do is repeat your opinion.     Instead of wasting everyones time here just tell us what you "know", thats all I asked some time ago. Persisting in saying "I know" and nothing else is behaving like a dick. If you can't say for legal reasons or whatever just say that.
