QPR must be desperate ! In any other situation Barton would have been sacked. I wonder how long it will be before he gets 'provoked' into a similar scenario to the Man City game ? - still he's only got 26 league games in which to behave ( fat chance ) edit.... I actually prefer my team's players to have the passion that Barton possesses - he just needs to channel the aggression into the correct use of his talents.
No. He couldn't be sacked for legal reasons, not without paying him millions to **** off. I reckon that many clubs will be looking at the situation with Barton (and Tevez at Citeh, etc) and thinking hard about what they write into contracts from now on.
Eamon - I am surprised that Barton wasn't sacked under any clause in his contract that related to gross misconduct. Let's just say he's been lucky. Who, amongst us, would not have been instantly dismissed if we had similarly behaved - why not him - just because he is a footballer ? I feel that Barton is never quite as effective when he has to ' control ' himself - holding back takes away a lot of his usefulness... pity really because players should get 'stuck in ' - playing hard, but fair should be achievable. I fear that Barton will get provoked when he eventually returns to the side ( and TV cameras will be right up his arse )
Totally agree. But he is not the only one. However, it's not that easy. I am sure that the lawyers looked into it to see what they could do ... and this is what they came up with. Sad. Players have the upper hand these days in contract negotiations. If clubs are desperate enough (like Warnock was) they will pay well over the odds. In years gone by club chairmen stuffed players with their contracts, now the players have agents who know exactly how to manipulate contracts. I agree that fining him a few weeks wages means absolutely nothing. If we were fined a month or two's wages then we would be in the ****. We would be thinking about how we would pay the mortgage or be saying goodbye to our holiday for the year. He can do all these things and has oodles to spare. It isn't fair and never will be whilst there are billions coming in from TV (which we pay for indirectly from TV subscriptions and increased product prices due to enormous amounts spent on advertising) and clubs are allowed to rack up miliions and millions in debt, but that is the way it is.
Always - Player just generally have too much power in the modern day game which is wrong. Trust me, I don't think there a R's fan on this board that didn't want Barton sacked but they couldn't do it the only way to to buy him out of the contract. As part of Barton staying they have added a clause which allows us to sack him if anything like this happens again, Eamon has it spot, the agents are causing the players to have unreasonable contracts.
I think you'll find 'gross misconduct' applies to all contracts, it's just that the club have to be seen to be 'reasonable' in the way they apply such 'charges'. Most would agree that what happened was 'sackable', but he would have argued that there was 'provocation' and the club would have viewed the uncertainty of upholding such a charge as too risky to procede. The fact they've now added that clause to his contract is pretty watertight. I'd like to think he'd now concentrate on making up for his poor first season and show us the side of him that served Newcastle so well. Perhaps I'm hoping for too much...
