This delay in announcing the findings of the QC regarding Cellino can only mean one thing, there is doubt about Cellino being blocked from buying Leeds ... surely if it was still no then announcing the result is pretty straight forward ... Cellino's lawyers must have made a very good case, because if the FL stands by its ruling and its ethically wrong, then Harvey and chums could face serious repercussions ... I think the FL are trying to make their ruling absolutely watertight, and I still feel that they are going to block Cellino and set Leeds up for a sale to Farnan .. remember it was his buddy the MP who "urgently" met Harvey to address his "fears" if Cellino were to buy the club ... I am really worried about Farnan getting Leeds, it smells of a pure money spinning move whereas Cellino at least looks like he wants to bloody some Prem club noses Sent from my iPad using Tapatalk
He hasnt been found guilty in Italy, so the FL have no basis to block him as yet. A specialist in Italian law will be putting that point accross at FL HQ I would expect
Normally where peoples livelihoods are depending on an outcome (eg wages) if the outcome would rectify that problem the decision is usually pushed through pronto, so people can get on with their lives. Therefore IMO and it is just an opinion, Things are suggesting he will be thrown out Hope im wrong would love you to get him
Bucks wasnt he fined 600k and have his yacht taken away ? I know we are talking Italy here but can they do that to innocent people
And how many stages of court are there in the Italian legal system? Four is it? Something like that thinking back to the foxy noxy case. Not as cut and dry as it is over here, so technically going of the first stage isnt conclusive that he is guilty, innocent until proven otherwise. I could be completely wrong though mate, you probably know better about the law being a Millwall fan abroad <on the run>
Bucks one area that no one has mentioned yet (i think) is if this QC rules in favor of cellino can and will the FL be able to appeal against it ?
spot on Eire, and with this knowledge why are FL dragging this out? I know it sounds conspiracy theory, but I really feel that the FL wouldn't be sorry to see Leeds fold completely, because there's been no urgency at all over the past ten years to help us ... even going to the extraordinary lengths of getting club CHAIRMEN to vote for an unprecedented points sanction was designed to get us relegated to Lge Two and hope that Bates packed it in and shut the club down ... at the same time they held back the golden ticket which meant we literally had no players until about a week before the season kicked off ... nope, Leeds and Revie have still not been forgiven Sent from my iPad using Tapatalk
I dont think the can. The buck stops with the QC I think. Again, I could be wrong I'm no legal eagle!
The only problem with that is say Cellino's gets to the very last stage of whatever the appeal process is in the Italian courts, and is found guilty. Whilst any of the current football club owners could in the future be found guilty of some offence that contravenes the Football League rules, this issue the FL have with Cellino, is that they are already aware that these proceedings have taken place, that Cellino has already not been found innocent at the first stage of the case. I am sure that the FL's argument to the QC running the appeal, will be, if the process finds in favour of Cellino, and the FL are bound not to restrict his ownership, how will the situation look if Cellino is then ultimately found guilty at the highest level under the Italian justice system. It is for this reason that I also think the QC will find in favour of the FL. He's been found guilty of an offence that FL feels that excludes him from passing the Financial Fair Play rules, whilst he may subsequently win that appeal or not, this may take a number of months or years to happen, and thus if the takeover was approved now, even on some sort of interim basis, the Fl would either be left in the situation of either allowing Cellino to remain as the club's owner, in which case this would make FFP even more of a mockery than it is now, or else be left in a situation where by they have to remove an owner from a club, and imagine the uproar that would cause for both the FL and ourselves. I would envisage that this scenario would be a legal nightmare for both club and league, and if not sorted out quick and amicably, I could see a point where the FL would be forced to withdraw/suspend our football league licence, and I wouldnt be surprised if this type of argument hadnt been put forward by the Fl legal representitive to the QC on Monday. This is the dilemma the QC is having to face. Cellino saying he will win his appeal in Italy and be ultimately found innocent, and the club needs a new owner with money now, against the FL saying he has been found guilty in Italy already, and they dont consider that he would win his appeal in Italy. One thing for sure I wouldnt want to be the guy making the decision either way.
MC needs to restructure the deal so that he has many investors all under the FL percentages rules that allow them to be kept hidden, just like the other scoundrel did.
They've both said that's the road they're going in separate interviews this evening. Sorry I haven't links to the interviews jonny
