Emiliano Sala contract not legally binding, Cardiff to tell FIFA Last Updated: 25/03/19 12:11pm please log in to view this image Nantes have pressed Cardiff for the £15m fee for Emiliano Sala Cardiff City will tell FIFA that the contract to sign Emiliano Sala from Nantes was not legally binding. The Welsh club have refused to pay the £15m transfer fee for the striker, who was killed in a plane crash two months ago. Nantes have complained to FIFA, and Cardiff have until April 3 to respond. Cardiff will argue that Sala's contract had been rejected by the Premier League and was therefore 'null and void'. He had been unable to sign a revised deal before his death on January 21. please log in to view this image Tributes are paid to Emiliano Sala outside Nantes' Stade de la Beaujoire after he was killed in a plane crash on January 21 Cardiff will also claim that further contract clauses - proposed by Nantes - had not been met. Nantes say they are fully compliant with FIFA rules and point to the fact that FIFA registered the International Transfer Certificate on January 21, 2019 at 5.30pm. A Cardiff spokesperson said: "The club is aware of FIFA's request for a response by April 3 and is processing that accordingly. We have no further comment at this stage."
This was never going to end well, clubs bitching about whose done what isn't nice to see, bit like washing your dirty laundry in public.
SURELY YOU INSURE A £15m ASSET AGAINST DESTRUCTION DURING THE DELIVERY PROCESS!! I know it's a bit insensitive dehumanising it - but that's basically what you need to do!! If I order a new guitar worth £250 I ensure that it is insured for the full value. If I order one worth £2000 I do the same. And I'm not a business person - just a customer and a sensible person.
From day 1..Cardiff never seemed likely to pay the transfer fee. Difficult to understand why not, but I suspect what Marcus says that they did not secure insurance against what essentially is a company asset. I'm not privy to the facts, but from the outside this doesn't sit or feel right and isn't making Cardiff look good.
Even if Cardiff have a sniff of a right to do this, they are hardly gonna win any popularity contests at the minute.
If it's right the PL had knocked back the contract terms surely they had nothing to insure? Sent from my Moto G (5) using Tapatalk
then it begs the question why an international transfer certificate is released. One club is telling porkies.
That or the PREM and FIFA aren't communicating which wouldn't suprise me either. Sent from my Moto G (5) using Tapatalk
This leaves a horrible taste in the mouth. He was only on that plane to play for Cardiff. My view is that Cardiff City is a horrible scummy club with no morals. I now hope they get relegated and go bust.
And the mirror of this is when did Nantes cancel their insurance. If there wasn't a protocol to ensure that insurance cover is in place while a transfer is being completed, then I suspect that there will be in future.
Absolutely - I would assume that, if FIFA have (as Nantes say) sanctioned the deal and signed off on it from that date, then they would stop paying insurance. Again it feels insensitive to dehumanise, but you don't keep on insuring a car you no longer own (or taxing etc.) If I was the buyer, I would've certainly made sure that the item was insured fully to the value paid. Wonder how far down the line we were when Cabanas got shot in the head? I know he survived but he certainly couldn't play football any more
I can imagine, (and I stress IMAGINE) that there may well have been scope for a misunderstanding from what I read here. Petty details, not completed but would have been. Not a problem except for what happened on this occasion. FIFA had sanctioned the international side. Prem had not sanctioned the UK side. Nothing about the French League or at what stage they were at but I'm guessing that they had sanctioned at their end and it would be at that stage that Nantes may have cancelled their insurance cover. They may not have known about the Prem. I suspect that there will be fingers of blame pointed every which way if this comes to an arbitration court hearting.
Absolutely - I know in reality that buying and selling a "person" as an asset isn't like buying or selling a guitar or a car and there are far more things (especially in this world of red tape) that need sanctioning before a deal is finalised. There is a hall of a lot of stuff I guess only those in football know about and, if I had bought a house and it turned out to not be what I wanted, I would use any means necessary to get out of paying for it! And this is seemingly what Cardiff are doing too - I truly don't blame them - if there is a way they can get out of paying for the item which did not arrive, then I expect them to try. Think the whole issue with this is down to the fact that it is a person we are talking about not an "item" and that is why there is such uproar. People are saying they're heartless pulling this out like this - but they are a business and any good business person will find the loophole they need to get out of paying for something they never received - regardless of the sale agreement!
Cardiff seem to be saying that they offered to put him on a commercial flight but Sala's agent turned down their request and booked a private flight with a pilot who didn't have the correct badges. I'm not sure that matters one jot if the deal was signed off.
