Always going to be a shadow hanging over this one, but fair play to the lad he has always insisted he is innocent. Hope this decision clearly proves him innocent and he can get on with his life.
Not sure it's done that yet. Haven't they just cancelled the original conviction but said there must be another trial? He'll need to wait to be found not guilty there to be considered innocent by the general public. In fairness to the lad he does seem pretty convinced he's innocent and this is a big step in the right direction from his POV. Problem is only 2 people actually know what really happened.
No matter the eventual out come, he's a man with an average career behind him. Even if found innocent the stigma will always be with him.
3 actually. The other Accused was found not guilty which makes the original jury decision bizarre. I am surprised its been quashed but even more surprised there's a re trial; how fair can that be with all this publicity?
The original trial had a massive amount of publicity and we could argue if that proved to be positive or negative in the case. I feel that having a re-trial (if he was guilty) could rebound however, there seems in my mind to be some justification as its his defense barrister/solicitor has chosen this route. Interesting all the way guys, I've no issue either way but the Judaical system in this country has proved to be inconsistent on too many cases. As long as the process is right..... then the right decisions should be reached? Talking about decisions ...RS and SY must go....now.
The decision to quash is actually a victory for the judicial system. The inconsistency was entirely from the original jury who came to the curious conclusion that the woman gave consent one minute then was incapable of doing so in the next. Whether he'll get a fair trial remains to be seen but at least the jury will hear all the evidence this time, including the woman's tweets that she was hoping for "a big payday". Good to see some common sense here. On our board we've had Dai ranting that Evans still has a conviction and has to prove his innocence.
I honestly can't work out whether he's a wind up merchant or genuinely dull. Most of us lean towards the latter.
