Hi, I was hoping you guys could give me some advise on the best way to sell some spare tickets! Me and my family bought some tickets for the Hull vs Liverpool game but since it has been re-arrange 3 of the party can no longer attend. What would be the best way to get rid of the tickets? I have 1x Adult and 2x Over 65s and would like as close to what I paid for them as possible. Thanks for your help!
These are the tickets the club claim are non refundable right? We had a thread when that was first announced. The upshot is that it's bullshit and basically not legal. http://www.not606.com/threads/liverpool-tickets.295316/ Just demand a refund from the club.
Someone really should take them to task on this. The rules seem pretty clearcut but as always City under the Allams think it doesn't apply to them. They get away with stuff like this far too often.
PLT - I have tried my best in taking them to task a couple of weeks ago....... Email went as followed (formatting not copied too well) Further to previous communications to the club, regarding your illegal practice of offering no refunds for the Liverpool game should the game be re-arranged, I will now be reporting this the the OFT as the illegal terms still appear on your website. As much as the current regime likes to ride rough shod over fans, this affects all the visiting fans too, so I will also be informing Liverpool of their rights under Consumer Law. This case has already been dealt with by the Office of Fair Trading Supporters have won a significant skirmish in the battle with clubs over the vexed issue of ticketing when the Office of Fair Trading ordered Tottenham Hotspur to offer refunds for rescheduled fixtures. Spurs accepted the decision and, according to the OFT, "agreed to remove conditions on its website that 'tickets cannot be refunded or exchanged under any circumstances','' because this breached "the Unfair Terms in Consumer Contracts Regulation 1999. "Tottenham Hotspur has acted responsibly by changing its terms and conditions to ensure they provide for full refunds in the case of rearranged fixtures,'' said Mike Haley, OFT director of consumer protection. "When a consumer enters a contract to buy a ticket to a performance or match there is a clear date, location and time, and there may be any number of valid reasons why ticket-holders cannot attend on a rescheduled date. We are asking all clubs in the UK to ensure their terms are compliant with this aspect of the law.''
Reply received was.... Many thanks for your e-mail below which has been forwarded from our Ticket Office. I also believe you have been in communication with the Premier League yesterday. Following on from my own dialogue with the Premier League yesterday I confirmed to them that advance warning was given to supporters, at the point of Liverpool tickets going on sale, that the Club would not be offering refunds should the fixture move as a result of Liverpool’s possible progression in the FA Cup. Therefore supporters would be under no disillusion when choosing to purchase tickets for this match. We therefore feel we have been upfront and honest in respect of the situation having clarified from the outset our position on tickets for this match and having spoken to the Premier League we feel there has been no wrongdoing on our part. I hope this clarifies our position but should wish to wish to report this matter to OFT then please feel free. I believe the Premier League will be replying to you under separate cover. With best regards. Matt Wild Matt Wild Club Secretary
My subsequent reply.... Hi Matt,I have not made any contact with Premier League, as it is nothing to do with them. It is probably another disgruntled customer who knows the law.The contract is between Hull City and the consumer, and it is this contract you are in breach of. When a consumer enters a contract to buy a ticket to a performance or match there is a clear date, location and time, and there may be any number of valid reasons why ticket-holders cannot attend on a rescheduled date. We are asking all clubs in the UK to ensure their terms are compliant with this aspect of the law It makes no difference whether you give advance notice, you are breaking the law by not offering a refund.I will send this and your reply to the OFT.
And Hull Tigers reply was.... Many thanks Sent from my iPhone ^^^^^^ I think this just sums up the clubs rotten to the core attitude
I then made the formal complaint (the OFT has now been replaced). I copied the club into the attachments and forms sent. Hi Matt,Please find attached copy of official complaint made to the Competition and Markets authority which is the regulatory body which replaces the OFT for your records.I do hope you consider your crazy stance on not offering refunds, what is the logic of it?
Response from the ex-OFT Dear Mr Unfair Premier League Ticket Terms - No Refunds Offered Thank you for your reporting form to the Competition and Markets Authority (CMA) of 2 March 2015. The CMA welcomes information about practices in the marketplace, but cannot respond in detail to individual complaints. The CMA will not normally enter into correspondence about its decisions on whether to give detailed consideration to the complaints it receives. However, we have noted the contents of your email, and brought it to the attention of our pipeline/intelligence teams. We use the intelligence we gather, alongside our Prioritisation Principles (www.gov.uk/government/publications/cma-prioritisation-principles), to develop our pipeline of new projects and programmes of work and make the best use of CMA resources in terms of real outcomes for UK consumers. I hope this information proves helpful. Thank you for highlighting this issue to us. Yours sincerely Alan Sullivan Contacts Team Competition and Markets Authority
They did also mention if they refuse refunds take it up with Citizens advice who offer free legal services. Well I am doing all I can to stick up for us ordinary folk but its tough going.....
Chazz - I can go - but we are seeing people who cant make it emerge who I was hoping to help. And I must admit our club are making it really easily to fall out with them at every opportunity
Its the principal of the matter though, just another example of them thinking they can do what they want regardless of the fans or the law. Well enough is enough I will challenge them at every opportunity like an annoying ****ing wasp. I have feeling my season card won't work anymore lol.
Even if the law protects them, it's a appalling way to treat fans. If the balance sheet's so fragile they can't stand the loss, it can't beyond the wit to manage two lists, one for tickets wanted, and one for tickets available and just exchange them if possible. It could even be done on here. People could post the seat numbers they want rid off and people could PM them an offer. The problem with that would be the lack of controll on who gets them, which runs the risk of Liverpool fans being in the home end. Given nothing was done when Cup Final tickets were reported as being sold in the HDM, I wonder if anything would happen now? After all, if I went in and bought four tickets, they wouldn't ask me who the other three were for.
It's not illegal, the wording used puts them in the clear, we checked it with a consumer lawyer. Not illegal, just disgraceful.
There'll be plenty of seats in the Liverpool end if they're some of them are boycotting due to the ticket prices, so wouldn't need to try and get in our end
