    Hull City Name Change Application


    The Football Association has agreed with Hull City to clarify the position regarding the club’s name change application.

    On Wednesday 9 April 2014, The FA Council rejected Hull City’s application to change its playing name to Hull Tigers.

    The club has chosen to commence an arbitration under Rule K of the Rules and Regulations of The Football Association to challenge the decision of The FA Council.

    Any arbitration commenced under Rule K of the Rules and Regulations of The Football Association is confidential. However, in the interests of the supporters, The Football Association and the club have agreed to confirm that an arbitration has commenced and once a decision has been reached it will be published.

    All other aspects of the arbitration shall remain confidential until such time as a decision has been made.

    I know it's probably their only stock image for us, but I like how the FA used the old badge rather than the piece of crap we have now.

    I get the feeling the FA don't really like Allam too.

    The FA have got two weeks to respond to the appeal, which I assume has just gone in, so that puts us mid October.

    There are in fact, 14 days for everything, 14 days to respond, 14 days to decide an arbitration chairman, 14 days to oppose the appointment, 14 days to submit another one, 14 days etc etc

    The tribunal panel can be a single person or a three man panel, to be decided by the two parties, I suspect it will be a three man panel(obviously they've got 14 days to decide).

    This could go on for months.

    From the appointment of a chairman the Tribunal has 119 days to fix the hearing. Of course that can be varied by agreement of both parties. I wonder if they'll call Assem as a witness.

    Do we know what Rule K is ? Is it because Allam feels he has been over-ruled in favour of the supporters?

    What decisions can the tribunal come to?

    The Tribunal does not have the powers to tell the FA to change the name of Hull City to Hull Tigers.

    Rule K 1 (d) says:

    Rule K1(a) shall not operate to provide an appeal against the decision of a Regulatory Commission or an Appeal Board under the Rules and shall operate only as the forum and procedure for a challenge to the validity of such decision under English law on the grounds of ultra vires (including error of law), irrationality or procedural unfairness, with the Tribunal exercising a supervisory jurisdiction.

    The Tribunal's sole remit is to determine whether the decision by the FA was within its rules, was rational, was procedurally fair and within English law.

    Rule K takes up about three or four pages of the FA handbook, it's basically just a way of appealing to the FA about anything you're unhappy about.

    The rules are about processes, there's nothing specific about what can and can't be appealed, it just details how you appeal against something.

    It's a good thing that we will only be subjected to the beginning and end, as I am guessing the middle might be a tad cringeworthy.

    I think there is a good chance it will go Allam's way or he wouldn't have done this, he's took his time so i guess he's been reseaching it

    Don't worry folks, it's a done deal. Decision was made, it won't be unmade. CTWD have stood down. Plenty of people have stated as fact the FA won't change their minds.

    Nothing to see here, it's just Dr Allam going through the motions.

    He lent millions of ££££ to Hull city afc,in the belief we were called Hull city tiger, and he would never have done so,if he'd known any different (his words).

    His research dept aren't that hot are they <doh>

    No because its against the FA's rules. This isn't an appeal it's arbitration. The Tribunal looks at whether the decision was legal under the FA's rules and English law. If they decide the decision broke the rules or the law the application is sent back to the FA Council to reconsider in light of the Tribunal's findings.

    I explained on CI why I don't think the FA broke their own rules or the law.
