I heard at the time (that it became general knowledge) on Radio Newcastle that it only came to light when SAFC received the player lists from Uefa (or fifa) for the drug testing and then SAFC investigated why he was not on the list and highlighted the error therefore the premier league are just as culpable and is probably why we did not hear at the time. As another poster has pointed out ALL of the clubs were aware and happy with the punishment so I think this is journo's stirring things up
"As for Fulham, Norwich & Cardiff going legal re Sunderland, do me a favour! We reporters went to them at the time & they weren't interested." From a mirror journo on twitter No leg to stand on, clearly
AyeI forgot about that! When we informed everyone all clubs were made aware and no objections were raised. Now they suddenly want us docked points!!
Oh and one other thing. Hope all three of these twats stay down for a long time due to this disgusting show of desperation. Only one of them can actually stay up can't they? So explain the point of them taking legal action? U Are they going to ask them to relegate us 3 times so they can all stay up?
They are desperate. We were down and out months ago, way behind, a horrible run in at the end of the season, and they all thought we were down. Now we are above them, 2 are relegated and one is one foot in the championship, they are desperate to try and gain some ground. Its funny aswell, Fulham beat us when Ji played, and they still want to dock us points... you took 3 from us that day and still got relegated you twats!
The most they can get is 1 point for the game, plus 3 points 'punishment' (although it will probably just be 3 points). If Norwich lose their games and we draw/win one more, then even 3 points won't make a difference, so will they give up? Even if lose our two games, if Norwich lose theirs then after a 3 point deduction, our goal difference keeps us up? What's the point? Also, they can't all stay up? Besides, apparently the teams are compiling a list of precedents. Does that include West Ham vs. Sheff Utd? Is this nothing but a paper trying to stir trouble by making up a story?
Sky 401 Sunday Supplement, talking about it right now. They're all journo's for the dailies and they all agree it's, to paraphrase, "bollocks". So I don't think it's the papers stirring it. It's just 3 clubs who couldn't cut it on the pitch hoping their lawyers will play a blinder! Morons! No class or dignity.
Regarding the article in tthe Guardian concerning the ineligable player Ji, they quote rule 6.9. however the fine SAFC received was not for breaching this rule. The BBC reported at that time "However, Sunderland's case was dealt with under Premier League rules B14 and U11 - rather than FA rule 6.9, which was applied in the aforementioned instances - and the club now consider the issue dealt with. "The issue of Ji Dong-Won was explained in detail at today's Premier League shareholders meeting and no issues were raised by any club," read a Sunderland statement. "The club has never accepted any wrongdoing, but did acknowledge that a technical fault occurred and as such were fined by the Premier League accordingly in December. The matter is now closed." The FA rule under which Marine were punished does exist as a "back stop" for the issue had the Premier League not acted under its own laws. However, there is a possibility that a relegation rival could appeal against the decision not to impose a points penalty, which could potentially strip Sunderland of the solitary point - taken against Southampton - that they won during Ji's four league matches. " So fingers crossed - the other teams in the league could have objected but didn't. Surely it's too late now and any objection now - will be thrown out and desevedly so.
FA wont reopen a case and give another verdict. That would set a precedent that their rulings arent final, and everyone will appeal everything. Double jeopardy has to exist otherwise everyone will be trying to 'sue' everyone else.
If a player objects against a punishment it can be increased if the appeal is flippant. It would seem reasonable if these three objectionable teams were asked to accept a points deduction next season if their appeal against an existing FA ruling were considered flippant.
I don't blame them for trying! On the pitch it is a rather underhand thing to do, but in the boardroom amongst the financial implications of relegation they must try anything! If you had a huge chunk of your finances at stake you would do the same! I remember an fa cup game against Tranmere when they had a player sent off deep into injury time, but a huge mix up resulted in a player coming on to replace him! The player who came on actually headed away our resulting free kick! We lost and never got a replay! I remember being outraged at the time! Even for the 30 seconds that the man was on the pitch I felt that the game should have been replayed! A bit harsh on Tranmere, but I felt they should have been punished for sheer incompetence!
It really saddens me to think my club is involved in something like this. I am hoping that it is just a paper story. If it goes to court I hope you kick some lawyers arses like you did to a few teams recently to get to safety. Good luck in the Prem' next season.
No because we'd sure them for not having their paperwork in in order and having Ji marked as eligible to play. We would have found out after the first game he played if the Premier league had the records up to date. Fact of the matter is, if it wasn't for us telling them, Ji could have played every game this season and Nobody would have been non the wiser.
