Apparently Uefa have said that Courtois could play against us and any contractual term re payment would be nul and void. How's that then? Surely if we own the player that is our prerogative and surely AM agreed these terms when signing the loan. Seems absolute lunacy.
Both the UEFA Champions League and the UEFA Disciplinary Regulations contain clear provisions which strictly forbid any club to exert, or attempt to exert, any influence whatsoever over the players that another club may (or may not) field in a match.. Uefa's quote. How this rule can extend to a player we own is ridiculous. Either way Atletico should honour the agreement if we draw them.

That is quite right, Courtois should and will be allowed to play. Uefa have said as much. It is unfair that other sides have to face Atletico with him yet Chelsea don't
UEFA on a similar case about a Celtic player last summer: "Any agreement between the two clubs that this player wouldn’t play against Celtic should Elfsborg be drawn against them is purely between the clubs. "UEFA would not have any involvement or consideration of this agreement, it would be neither endorsed or enforceable by UEFA." One rule for one?
he is our player so should not be allowed to play against us suppose we win 3-0 and he has a mare suppose uefa would want match replayed
I think you are misreading that. UEFA are saying they can't force the club to drop the player whether there is an agreement or not.
Atletico still might not play him, as they want to keep him next season. So don't want to risk upsetting Chelsea. Chelsea should really show some class in this whole situation and allow the lad to play. I doubt they will though
Stop wumming. It has nothing to do with class. We've let AM have a world class keeper on loan for 3 years and let him play in the super cup against us. This is however the biggest games of our season so why should we allow a player we own to compete against us? They agreed a term regarding payment if we were ever drawn against us so should honour that agreement or drop him.

What is a farce about this (and no real shock given it's Uefa), but if they didn't want two games in Madrid in the same week, they should have clarified the position and set out exactly what would happen BEFORE the draw instead of the hour long back slapping and talking bollox they do before every draw. More examples of us being screwed over by them so us having to play a final 'away' when they previously said this would never happen again after Liverpool's final (Rome?)

Courtois will not play against us. They know that if they try to **** us over they won't get the player on loan again.
