An ITK mate of mine...

    A chap I know has a brother high up in the NUFC structure and has called a few things right over the years in terms of insider info etc.

    Apparently Ashley is livid with JFK for a few reasons:

    • JFK is loathed by most chairman and agents who refuse to speak to him on transfer matters
    • The press despise JFK for his historical rants and are trying actively to undermine the club... thereby reflecting badly on MA
    • The French detest JFK and refuse to speak to him on transfer matters (Charnley is in the box seat on the Gomis deal now)
    • Two top NUFC execs have already quit over the way JFK acts around the club

    It's clear MA is regretting the appointment of JFK and that it is BECAUSE of JFK that nothing has been moving in the transfer market by now.

    Apparently JFK (who is on really low money) has been told he has 2 weeks to get the required players 'over the line' otherwise he will be sacked.

    The above kind of makes sense to me and I reckon MA has rushed in yet again and is now paying the price.

    Interesting stuff ACS. Quite comical if he is sacked before the season even starts. You have to question how the appointment came about.

    Would anyone want to speak to that fat walking heart attack? No, of course not. We won't be getting anyone over the line. This is all Ashley's fault for hiring the disgusting bastard in the first place. Now we have apparently ended negotiations with Lyon over Gomis. We really are a complete embarrassment

    There's no question why the appointment came about. Kinnear stopped working on grounds of ill health - he was not sacked, could not be sacked. Ashley's option was to either pay him up there and then or just sit tight and hope that he was never declared fit to return to work. Ashley, the gambler, took the latter option which spectacularly backfired when a doctor said he was fit enough to work. Joe has 2.5 years minimum left on his original contract, Llambias didn't want to carry on, quid pro quo JK is DoF. On the face of it, seemed logical and remains logical (even though few of us would have taken the same road). So it remains that Joe is a fcking useless bugger in the higher echelons, but now Ashley can sack him with little/no compensation loss because he is failing, categorically, in his duties. Putting in a performance management plan, even at that level, by saying "your only job is bring players in, do it by x date or you are done" is fairly typical.

    Even if we manage to sign some players in the next 2 weeks, if others such as Charnley are having to do the job then JFK should and hopefully will still be sacked.

    I hope the ITK is accurate because Kinnear getting the boot would be a great relief.

    One point though - the press try to actively undermine our club anyway - JFK just makes it all a lot easier.

    Do you work in employment law ?

    A lot of this seems a bit dubious. A person can be terminated on health grounds if he is unable to perform the duties of the job. That would seem to apply.

    Moreover, fixed term contracts aren't automatically extended for the length of an illness. Kinnear would have been hired from a start date to an end date. He might or might not have been entitled to be paid if he could not do his job, but the end date wouldn't be postponed.

    Again, if he was entitled to insist on his contract being carried out, he could not have a term (such as sign players or you are sacked) inserted in it without his consent.

    The term in relation to the employment contract would be "frustrated", ironically. The courts are very reluctant to accept an argument that a contract of employment was “frustrated” due to long term ill-health. Employers are expected to try to find alternative work, or consult with the employee and seek medical confirmation. We will never know the detail of this, but the contract could have been deferred - I only suggest this as possible, as it would represent the cheapest course of action; no court case, no pay off and comments of "of course I'll keep a job open for you Joe....if you don't die first (snigger)". Of course I could be wrong, I was just trying to find logic in it - it may be as ridiculous as Ashley re-employing the fat turd.

    We're also talking about football, not the land of normo's.

    In terms of a PIP (Performance Improvement Plan), this could easily be inserted not contractually, but as an amendment of duties which WILL be in his contract (the company reserves the right to change yada yada...). If his role from day one was bring in players, and within a month he had failed, he could be introduced to performance measurement. If we were in the land of normo's, he'd probably still be on probation and unlikely to get through it. One week's notice, in lieu, job's a good 'un.

    While it would be great if it was true ... it's not!
    If the chap with a brother want's a little wager - with the winnings going to BRF - I would be happy to oblige.

    If anybody thinks a chairman or agent would let financial interest be harmed due to personal feelings you are nuts... money talks, unfortunately, and due to the size of egos in the game there is a lot of ill feeling.
    The press, for whatever reason, love putting it into NUFC. Nothing has changed but if you think Ashley worries about media or populist opinions you are mad.
    I would be surprised if Charnley was not in the box seat on the Gomis deal. He deals with finance.

    That said, as I type, I pray your source is correct and the fat lizard leaves our club.

    I tend to go with Occam's razor in most situation: always choose the simplest explanation. Ashley rated Kinnear. That's why he hired him as manager. He still rates him and that's why he hired him again.

    Ashley REALLY rates Kinnear. In fact, it has been put on public record, Ashley thinks he is the most honest manager he has ever employed.
    He has even had the occasional pint with him in the Orange Tree pub, Totteridge Village.

    Sounds a bit far fetched.

    Ashley has no right to be furious. He is, after all, the one who employed a man with none of the required expertise or experience to fulfill a Director of Football role.

    Every one of us knew at the time that this appointment would be a spectacular failure. As a result, we're approaching the start of the new season with not a single senior signing completed.

    The process of transfers have changed dramatically since Kinnear last dealt in the transfer market. Ashley should have known that. It's Mike Ashley's fault.

    I believe this option should be considered. Spirits in the camp must be at an all time high. I'm sure the lads have taken great delight in leaving a donner with everything on in Yohan's kit bag, and all come in with comedy afros to celebrate Benni's new name. The fans have had plenty of banter about him amongst ourselves, and oppo/rivals have been prompted into a bit of action. There doesn't appear to be a loser if he sticks around. Just genius by Ashley.
