unless theres new evidence i fail to see how we are gonna win the appeal (sorry to be negative) as the reason he got paid was cos we didnt investigate his claim. so unless we've found a way to prove he never formally made the claim then i dont see how we can appeal it as the law says we have to investigate claims of racial discrimination when raised. thats how i understand it anyways, fair chance im worng tho
I agree with jokeykid, putting all the race allegations to one side, because they were not upheld. I would be interested to know on what grounds we are appealing?
I think we should have paid the money and moved on quietly if there is nothing that we can do about it. At the time of the announcement the olympics was in full swing, although football fans may have taken note I don't think it was national news. You all already know that if bring it back to light, the exposure as well as the extra legal costs could prove far more damaging.
If black players who previously played for us without any issue are backing us, I cant see us losing the appeal. Were clearly not a racist club.
We wasn't found guilty of being a racist club. We were found guilty of " failing to investigate an accusation of racism" which is different, so I don't see how having black players back us can have any effect on the outcome.

I guess Scallys lawyers must see a way or they wouldnt bother appealing.
I would have thought it best to take this on the chin and move on. It is unusual for the employer to win this sort of thing on appeal.
I would tend to agree. We was not found guilty of race discrimination and although the race victimisation hangs over us, it was not by detriment. Also everyone will make their opinions regardless, we all know which side most Gills supporters fall on. Employees take employers to tribunal everyday of the week for wrongful dismissal, all because someone failed to dot a few i's and cross a few t's. I find it difficult to support an appeal based on my limited knowledge but of course I wish it every success.
