I was thinking about Terrygate yesterday and SB's insistence that Ferdinand could've done nothing about the trial as it wasn't him that complained. Now I don't know the ins and outs of law but I didn't think a third party could get offended on behalf of someone else, have it brought to trial and have that person forced to take part in said trial. Say for example Oddball and I had a row and Oddball used a racial slur against me. Now say North overheard that remark and made a complaint to the police who duly started proceedings against Oddball. If I told the police that it was just a row and myself and Oddball had settled our differences, could North still have the case pursued because he was offended by what he heard and have me dragged through the legal system against my will? I only raise this because that was Stan's obstinate defence of Anton Ferdinand throughout our debates and it had me kind of wondering. Appreciate anyone's knowledge of the subject to set me straight on this matter.
On a serious note Swords, i think the answer is Yes. I don't know the exact wording but it something about using words or behaviour that could cause distress to others in the vicinity of the comment. Even if you weren't offended by the remark then it could be judged that others in ear shot could be. I think this is even more so when the comment/insult/slur refers to race.
Trust me Swords, I'm right. On everything. You should know that by now. Complaint raised, Crown Prosecution Service investigate, if they decide the complaint is valid and there is a good chance of conviction, prosecution follows. But Yorkshire Hoopster will put me right in the unlikely event of an error....he is the one you should refer to on this, as he is a lawyer.
