    Elvis Lee Sentenced To 17 Years In Prison For Kicking Five-Year-Old-Stepson Tyler To Death

    A "wicked and controlling" man who murdered his "fun-loving, mischievous" five-year-old stepson has been ordered to serve at least 17 years in prison.

    Elvis Lee, 34, was found guilty yesterday of murdering Tyler Whelan, five.

    Lee admitted he kicked and bit Tyler on the day of his death but denied murder.

    The boy's mother, Stephanie Whelan, 27, was found guilty of allowing the boy's death. She will be sentenced next month.

    The kick was so hard that Tyler flew two feet through the air hitting a door at his home in Sheepwalk, Paston, near Peterborough, rupturing his abdomen and slowly killing him.

    At Cambridge Crown Court on Tuesday, Mr Justice Nicol sentenced him to life with a minimum tariff of 17 and a half years.

    He said: "Tyler had been left in your care while his mother took two other children to school.

    "His young life was cut tragically short. This has been a tragedy for his father, his mother and the rest of the family."

    Michael Borrelli, mitigating, claimed that his client was himself abused as a child and attributed the incident to a loss of temper.

    "He lacked a real appreciation as to the consequences of what he did because, despite the treatment he himself had been the victim of, he had never suffered serious injury," he said.

    But Mr Borrelli said his client had been cleared of cruelty and neglect allegations and should be sentenced on the basis that this was an isolated attack.

    In a statement, Malcolm Newsam, executive director of children's services at Peterborough City Council, said there were "lessons to be learned" following Tyler's death.

    He added that these were consistent with previous Ofsted inspections which had found weaknesses in the council's procedures to safeguard children.

    Sheila Scott, the council's cabinet member for children's services, expressed regret for the "terrible tragedy".

    She said that since last year the council had recruited an extra 25 social workers, reduced workloads and is now completing assessments of all vulnerable children in a "timely fashion".

    When I read something like this I feel like crying, then you consider that if this pool of bile behaves himself he'll be out in less than 10 despite what the judge recommended, I was abused as a child, I would never dream of putting another child the things I went through. Five years old, I really feel sick at what this person has done

    Hanging, electrocution or the gas chamber would be too good for him. He needs to die a long slow painful death and give him plenty of time to regret his actions.

    The Social Services don't come out of this smelling of roses either and questions need to be asked. What kind of organisation is it that leaves kids in the hands of sick monsters?

    Dont mention Social Services, how many times over the last 20yrs have we had enquiries into their actions, and that it must never happen again,spin spin and more spin, at the end of the day those in vulnerable positions never get the required protection because these people dont do their jobs correctly or if they do they are mired in red tape.<grr>

    Social workers = local government. Local government = cutbacks. Cutbacks = cases like this.

    Child abuse has probably been in since caveman days, trouble is the consequences have been diluted to their weakest. A slow garrotting should fit the bill.

    So he kills a 5 year old bairn and will go to jail for 8 and a half years (17 years = 8.5 years inside - I used to work in the Crown Prosecution Service - couldn't believe sitting in on my first trial and hearing the judge say "You have already been inside for 18 months which is the same as a 3 year sentence" - how the **** is 18 months a 3 year sentence?? - Life should mean LIFE - i.e. the rest of your life) ****ing joke and a disgrace - I disagree with the death sentence as a whole (mainly due toi its record in America - i.e. the states that have it have a much higher murder rate) but when there are no mitigating circumstances (being abused as a child is not a mitigating circumstance - it's a ****ing excuse) but sometimes death would be better for someone - or at least simply lock them up for the rest of their lives as they have stolen the life of someone so young - eye for an eye - not always but certainly in some cases

    I hate reading this kind of stuff, but you cant bury your head in the sand. and its happening somewhere in the world right now. sadly we will never get the death penalty restored.

    Somebody made a great point about National service.

    I think they is a great need for this and if we can get hold of lads/lasses from the age of 16 then hopefully the army could drill common sense and respect into them and having them leaving as adults. Im so sure this would have a positive effect on all crime rates lowering altogether.
