Do we know the size of the bloke assaulted? If he was a fat bastard, a simple claiming of removing the burger for the sake of his health may have sufficed.
There was a programme a few years back about reasonable force. It surprised me just how far you can go as long as you justify it correctly. I think it's changed since then too as in the right situation, there's now no over-riding expectation for you to walk away if at all possible. One guy got away with using a golf club to subdue a burglar another was found to have used reasonable force even though he'd kept on hitting the burglar when they were on the floor. His argument was the burglar was big and still twitching, so he feared for his own safety if he let him get up. Both were in the home though, which makes a difference.
