In the f***ed up world we live in.....I'd hazard a guess that Bullard wins the case and City are £? out of pocket.
Out of pocket £18k/wk less than if we hadn't ****ed up like this and had just paid off his contract.
We don't have to pay him anything! It doesn't matter what club or player, there would still be a hearing to set the president. This situation has never happened before, in modern football. No one knows the rules as there are none. In this case, all Bullard would get is the chance to appeal. If he wins that chance, he may claim also that instead of being sacked he should be on suspension, therefore we would have to pay his wage until he signed for Ipswich. If he won his appeal we would have to compensate his losses. There is a long way to go before we pay him anything. If he broke the club rules,guidelines or curfews, he cannot win. If he was involved in any activity that could be seen as Gross Misconduct or would be seen as such in general employment he has lost. I believe strongly that the only avenue to get anything from this is in a technical flaw in the termination, but that would not lead to major payouts.
As I mentioned earlier on in this thread, I have no information on this and I don't know what has or hasn't happened yet, but if it's true that we had at least two players guilty of the same offence, but only sacked the one that was on £45k a week, then I think we might well be a bit ****ed.
This is all getting very confusing. Is the hearing before the FA to determine whether or not JB can appeal against his sacking out of time? If so, what is the point? If the FA decide that he can, and he appeals, surely under employment law his appeal would be heard by someone in the club who wasn't part of the investigation whilst he was suspended. That may be Papa Allam. I would be astonished if Papa Allam reversed the decision to sack him. If the FA is determining something different (that his sacking was unfair possibly) then what jurisdiction does the FA have to make a determination? Surely such a claim should be heard by the employment tribunal or High Court? In respect of the rumour that there were 2 or 3 players guilty of the same offence then, if it went to court we probably would be in some difficulty. But surely his previous indiscretions and his conduct as a whole would have been investigated when he was suspended. If the club decided that taking everything into account there had been a total breakdown in the implied term of mutual trust and confidence between employer and employee that is in every employment contract, it may be considered that we were entitled to terminate his contract?? dont see Bullard winning a penny. Papa Allam is far to wise a man to allow a washed up haz-bean to get one over him. Bullard will end up broke before this gets settled. just saying like. there is always the option of a hitman ? how much do they cost nowadays ?
Not with Bullards track record we wont. Whilst not knowing who the other 2 were (but one could guess) Bullard was surely on his final final final chance before the summer trip. I am with Mel U on this one. ffs, Bullard is at it again now at Ipswich. Does that pr*ck ever learn ?
A valid point, I just hope we gave him the necessary formal warnings for his previous misdemeanour's.
I bet Bullards personnel file is inches deep in paperwork containing formal warnings. Dont see that as an issue at all.
You'd like to think that the lawyers we sought advice from about Bullard would have told us that we'd have to sack either all of them or none of them if Bullard didn't have his previous misdemeanours on his record, or else it would be obvious that he'd have a case for unlawful dismissal. Part of the reason the whole affair took so long was that we wanted to make the sacking airtight as it meant so much to the club financially. This would be a pretty obvious hole in our argument so hopefully not one that was missed.
Fair assessment as some of us have already posted. I Just dont see how Bullard will win this case. Some are blaming Mark Maguire but this will have been signed off way above his head before Bullard was sacked. I would like this to end up in court so everyone can see what a t*t Bullard was and what he got upto. If that day ever happens it will be way down the track. I wonder at what point the PFA will try and wash there hands of Bullard ?
Unless the lawyers advised the club not to dismiss him, but the club refused to follow that advice and sacked him anyway??
