I've read that Forest have been trying very hard to get MGW to sign a new contract without a release clause, for significantly more money. If they had any faith in the argument that it was a mere drafting error, those attempts would fatally hole that argument. They could simply have sought a declaration that the contract was to have contained the clause, if there was evidence to back that up.
