If a “scummy pap” took the photo – which I understand was taken in 1996 – then it has been in the public domain for all of that time. The ‘upskirting’ law came into effect nearly six years ago. So why did this woman not seek a prosecution at any point in the last six years? Did the “scummy pap” claim that it was in the public interest for him to photograph a woman with no knickers on and so it was not done for ‘sexual gratification, to cause humiliation or distress’?
