Because under FIFA regulations, you can't include clauses such as subject to medical or subject to work permit within the terms of a contract to a player, only when making a pre contract agreement, as judged in the FIFA case heard before CAS of Beijing Renhe FC v Marcin Robak. (Unless a more recent decision I'm not aware of, has overturned it) You can make an offer to a player subject to various terms, but if both parties sign the contract prior to all necessary checks being completed then it's a case "caveat emptor", let the buyer beware.
