I hope it goes to the full hearing. Based on the PL QC's arguments, the PL has a laughably weak case.
What was interesting is that the PL QC spent a good 3 hours trying to claim the Arbitration and CAT case were the same, only to then at the end of the day try to claim it would be difficult to prepare for 2 cases at the same time… surely if the cases are the same it should be essentially only preparing for one case?
The PL QC appeared to know little of the case and he quoted the wrong law several times. SJH's barrister was sensational in his approach. He had set a trap.
I think sensational is a bit much like. I thought he started strongly, had a really poor mid section then finished quite well. The Judge on the other hand put the PL QC in his box from the off.
I thought he handled them brilliantly. He pulled our guy a few times as well, however the finish when the PL QC stated he couldn't run 2 cases at once and the Judge destroyed him to the point the others were pissing themselves laughing was class. Then to finish on the phrase of we have thousands that have been viewing pretty much said "There is a huge public interest in this case".
He also pulled out chaps middle part apart and he had to go for a break to pull himself together. I feel this is a win. I think the CAT will go ahead. Whether the PL yield (@Roy Munson likes that word) is another matter. But given the fact that they (today) went to private discussion twice today suggests that anything confidential will not be brought out in the public domain. Or not who knows!
My view was a landslide victory and that seems the general consensus, but I have no idea about legality and perhaps heard what I wanted to
I feel we could have won by knockout had our guy kept it shorter and sweeter. I would instead say it was a resounding points decision.

He was flapping in the middle mate he didn’t understand his case law enough. He pulled it out the bad because the judge gave him the opportunity too. You could argue the judge “lead” him towards the point by suggesting he consider gambling cases.
