In all honesty regardless of the outcome, I thought the Judge was very very good. There's obviously over estimates on both sides. The fact the Judge took the complete piss out of Adam Lewis with regards his time restraints comment at the end there to prepare for a case had the rest of them all howling. Thought Lewis was a bore fest that repeated the same thing over and over - Mike Ashley owns NUFC. Thought Danny Jowell started really well, had a stinking mid section and then finished quite strong. Man of the Match - The Judge
Its finished for the day. No result today - will be notified in due course. Judge finished by mentioning the thousands of viewers online - reference to public interest perhaps?
Where are the experts who claimed that it wasn't a competition law case. SJH's advocate just ripped the PL's QC to shreds.
So for those needing a summary. The PL have argued that the CAT should either be thrown out due to Mike Ashley owning MASH that owns ST JAMES' HOLDINGS that owns NUF ltd That owns NUFC or that it should be held after Arbitration which will go ahead on Jan 3rd and last a week. St James' Holdings argue that the CAT was only covering the point of separation and that there are other arguments. These being the lobbying of Bein Sport as an outside influence, the lobbying from the clubs involved in the ESL, and that the PL didn't treat the PIF in a non discriminatory manner when applying the O&D test. St James' Holdings argue that the price of the club is now less than the £340m the deal was agreed for as a direct result of the PL delaying and will seek damages of £12m in addition to the cost difference between what the original deal was and what it will eventually sell for. PL argue that there is no way the club can be valued like that at present and CAT should be put on hold till after arbitration or a sale. NUFC have then hinted that the PL threatened to exclude them from the league unless the CAT case was dropped? Think that covers most of it.
More or less. And that the judge dropped a bomb which the Pl chap didn’t like at the end. Regarding the public interest. The fact that thousands of people where watching highlights this. If CAT doesn’t go ahead then it’s a disgrace.
He did at the very start too. Saying they would only go private in evidence that would be a crossover of the Arbitration case.
