Just revisiting the latest developments in KSA. WTO found they had breached Articles 41.1, 42 and 46 of TRIPS. That is - failure to provide legal remedy and access to justice within Saudi legal system and no criminal procedures or penalties. The Saudi's have introduced legislation creating a legal framework to comply with TRIPS, thus allowing for legal action against beoutq by aggrieved parties. That is significant. Massively. BEin and the PL now have a process to follow should they choose to do so. It is significant because the state are effectively allowing a legal system to challenge their actions.
Which by very definition means the state is not implicit in the said illegal activities. Which brings the whole PL argument for the state to be named director issue and subsequent disallowance re the O and D test. Is this new move an attempt, directly, to satisfy a possible request by the PL? I.E to allow the PL to pursue the allegations?
I suspect that this is a move designed to placate the PL and BEin. It is a lot wider of course, but the measures taken slign with the WTO complaint. It is the Saudi's conceding they were at fault and retrospectively applying a fix.
