If arbitration was lost we would know as one of the things that was agreed by the court of arbitration was to publicly release the verdict. The other 2 things they didn’t get which was to have the arbitration public as in have the whole thing not just the decision public and also to change the third person on the arbitration panel. This is a something they had in their back pocket but with Project Big Picture and the ESL cock ups Ashley and his advisors/lawyers have smelt blood and realised the Premier League and the top 6 don’t want anymore dirty lining aired in public.

Because in legal cases you keep all of your options open for as long as possible. You then argue what you want and then if the Judge doesn’t agree on that then you want option B and so on. It would have been more surprising and/or worrying if the documents didn’t set out all options.

The document I think you’ve read deals solely with Anti Competition claim which isn’t part of the Arbitration proceedings. They are separate proceedings and would seem to be designed to ramp up the pressure and the threats against the PL if the PL insist on continuing to block the takeover.
