    TUPE isn't always straightforward.

    In this instance Frasers are shutting down the operation.

    AN Other party (NUFC) are then re-opening the premises, do with it as they see fit.

    It stinks, but, they can get away with it legally.

    TUPE acts as if nothing has happened from an employee perspective so no time frame per say. The contract of employment just transfers over.

    Yes I mean the option is there for the new owners and it is then that applies the TUPE conditions because they usually want to keep the staff?

    If it’s a transfer to NUFC. Then that’s owned by MA. So he’s made the call not to use TUPE so it IS a cost cutting exercise. Albeit instigated in the grander scheme of things for the facilitation of the takeover.

    For me though they are NOT intrinsically linked.

    The shop has been transferred back into the NUFC pot of companies. From Fraser group. And currently MA owns the NUFC pot of companies.

    So legally the current owners have made the call. The decision is on Mike’s watch.

    What happens when the shop de-opens and the takeover hasn’t happened?

    It re-opens run by Castore whatever happens, but it's now under the "ownership" structure of SJH rather than Frasers Group. Which I'd imagine is an important part of any sale of the club.

    I'd imagine the way Frasers contracts are run that nobody wants to just 'take them on'. So they'll most likely invite people to re-apply for their jobs once a re-opening date is established. This looks basically like Ashley being Ashley, and taking another hit to his "reputation" for the new ownership.

    I also think that given castores involvement they would really want the club shop open even in these online days as the club shop is part of the match day experience. Even if sales are online it’s an opportunity to showcase the products.

    So the shop will re-open. And it will need employees. Which makes it more bizarre. But it makes me think it is cost cutting. That the shop won’t be opened till the end of the season and the takeover is complete. Savings potentially 5 months of wages.

    Anyone wondering why the staff are being made redundant - unfortunately people here understand the law and can't be forced to work as slaves so the Saudi's need rid of all the locals before bringing their Asian slaves over to run the shop and clean the bogs.

    So profits do not go to NUFC so that’s another revenue stream gone?

    Lee ryder does not appear to know the link between Castore and the Ruebans brothers.

    It's essentially no great surprise to me this... Castore is a direct link to the consortium, but I suspect that change will remain whether the club wins arbitration or not
