    Dear Badger, Dear Fellow Europeans,

    A little over 6 months ago, 147,000 of us stood together to fight for our rights as EU Citizens and to sign a petition for UK Citizens to retain EU Citizenship and Rights.

    So much has happened in this short time, that we thought this would be a good moment to update you on the progress of what has now developed into a significant landmark legal case (T-252/20) “EU Citizenship is a Permanent Status” in the European Courts of Justice (CJEU).

    Thanks to your support, on April 23rd of this year, our case was submitted - and now that the Council of the EU has responded, the next step is to present our arguments to prove that we have the power to retain our rights. How we move forward from here depends on the court - though we are expecting full legal proceedings to commence from January.

    We don’t know the full extent of the legal costs that will be required, and it is likely that we will need to raise additional funds as this case progresses, as is normal with cases of this importance. For this reason, we have increased our fundraising goal to £150,000 for this next vital stage of the case.

    Here is some additional context on the legal proceedings:

    Response to the Council

    The defendant in our case, the Council of the European Union, has now responded to our application of 23 April 2020.

    The council is arguing that all 66 million UK citizens (i.e. you and I) have no standing to bring this case in the Court of Justice of the European Union. What the council are essentially saying is that we have no power to stop them removing our EU Citizenship and rights. This is in stark conflict with the legal opinions received so far that no one has the power to take away our EU Citizens rights.

    Our lawyers have submitted what we consider the most robust response possible to this so-called plea of inadmissibility. We also think that we should have a good chance of overcoming this hurdle based on general principles of judicial protection.

    There are three possible ways forward from here: the Court agrees with us and we move forward to the substance of our case; the Court decides that our application is inadmissible, in which case we can appeal to the European Court of Justice, or the Court chooses to combine admissibility and substance.

    Timescales before the CJEU are difficult to predict, even without the COVID-19 pandemic, and depend on variables such as whether the Court decides that the Council and ourselves will have another opportunity to respond to each other; and/or whether there will be a hearing before it decides on the way forward.

    In addition, a number of organisations based in several European countries have applied to intervene in our case in our support. This is obviously good news as it means that our case has (already) reached a European-wide dimension.

    The Court will, however, not decide on the admittance of these interveners before it has decided on the way forward with the Council’s plea.

    In any event, there will probably not be any further decision before the end of this year - we will, of course, update you about any further developments in the case.

    We believe that it cannot be right for politicians and bureaucrats to be able to take away the rights of citizens, without their agreement, at the mere stroke of a pen.

    The legal advice we have received tells us that we can win this fight - and standing together, we may well be making legal history in the process. Please help us fight this case if you can.

    Another little Brexit complication. The BBC just had an interview with a French fisherman who dropped a hint that if they are kept out of UK waters they will turn their attention to the port of Calais. A few hundred vehicles on the slip road to the tunnel will test the resolve of the Gendarmerie, who will more than likely just go back to the nick for a well earned Beaujolais.

    A member of my family is involved in food talks and keeps telling me that any of my generation who aren’t wiped out by Covid or the under-funded NHS are going to get topped by the food post-Brexit. As the majority of this generation voted for the Tories and Brexit then there is a certain justice.

    I still await my Tory voting Leaver friends to tell me one - just one, I’m not greedy - one advantage of this Brexit malarkey.

    If anyone is looking for some positives, at this time of struggle, look away now.

    SERCO estimates it’s profits for the 3 months to July will be between £160 & £165 million.

    An interesting and rather worrying response from my MP to a mail I sent her asking her to work against a No Deal Brexit as it wasn’t what anyone voted for ....

    “Thank you for your email of yesterday. One of the huge challenges MPs like me face is that sheer weight of numbers of those who believe they were elected to deliver a no deal brexit. You write as if you think it is easy to stop this - I just ask how?

    Yours sincerely”

    Can you believe this? The numbers of MPs who believe they were elected to deliver a no deal Brexit? Scary thought, eh?

    I can well believe it. Remember, the Tory Party was purged of any non-believers before the election last year. Every current Tory MP will have been briefed that Dom & co. have been working towards no deal ever since 2016. The hedge fund managers and Russian oligarchs who funded the Leave campaign have staked billions on that outcome, and their interests come first, after all.

    It sounds like your MP is trying to soft-soap you with weasel words, which we will all hear a lot more of next year when the awful truth of no deal begins to dawn on people.
