It means the findings of the initial WTO report that found in favour of Qatar is meaningless and can't be used to discredit the Saudi bid for the club. Appeals are not currently being heard and won't be for a long while (if at all) so although there will still be piracy concerns raised by the PL anything mentioned in the WTO report is null and void.

No, the O&D test makes reference to the fact the PL can't take in to account legal decisions that have been appealed (and this appeal will never be heard).
So in light of this might that be why they've turned to hiding behind being unhappy with answers on ownership?
Sounds like PIFS lawyers have identified a legal reason why their concerns don't count. I dunno But I think it makes sense..
The only difference is that if the PL decide to use piracy concerns in their rejection they have to write a #summary of their concerns rather than just stick in a reference to the WTO report and leave it at that

It's not irrelevant, as the PL don't appear to have any proof to link the Saudi's to piracy (if they did the deal would've been rejected). The WTO report found the Saudi's did not do enough to prevent piracy but now the Saudi's have appealed the finding is no longer valid. I'm no lawyer, I'm not ITK or anything like that but the WTO report was widely regarded as: A. A big win for Qatar B. A big 'red flag' or stumbling block for the takeover. So the fact that report is now null and void until the appeal is heard (which will never happen) is a big win for consortium. Does it mean the takeover is more likely to pass? No idea, especially as the latest reports suggest difficulty in separating PIF from the KSA Government but it's clearly one road block which has been overcome by the consortium. So much importance was put on the WTO report given it's findings but that report no longer legally exists; there is no way that this can't be viewed as anything other than a win for Saudi's.
