And according to George Caulkin there has been no funds transferred either. So the deposit has not in fact been paid.
He's referring to the balance. A deposit has been paid and is recorded as the 'ring fenced' amount within the charge.
The deposit. There is a vendor loan for £150 million and payment of a ring fenced deposit not exceeding £13 million to facilitate agreement of the vendor loan.
You see I’m reading it different. I’m thinking the non refundable deposit is not actually transferred. Just in a holding pot. If the deal was off THEN the deposit gets released. I might just be clutching but if it hasn’t been released then it’s still on. Anyhoo he’s made it clear that both parties are waiting. If that’s the case then it’s still STILL with the PL to agree. FFS!
Could be that way. Without sight of the contract itself it is open to interpretation. The deposit has been ring fenced from the assets of Staveley. It could in theory be held on trust pending the outcome. It could also be conditional on passing the test. Again, we need the contract to clarify.
