Its mainly a written presentation of the existing evidence which is then pored over by CAS & there is then a hearing with lawyers which is a 1 day hearing apart from exceptional circumstances iirc .
Another thing with Mourinho is he's yesterdays news. His football philosophy has been superceded by the likes of Pep and Klopp. Maybe that's why he ended up at Spurs
Given that the entire investigation was based on selective stolen emails then their reticence to cooperate was understandable from a legal perspective.
If I was accused of something based on incomplete evidence, I'd be anxious to show the full picture as soon as possible in order to exonerate myself. Tbh, I don't trust any of the parties involved here.
Exactly. "Oh, that stolen video of me murdering someone is completely selective. The full video I have shows it was completely innocent." "Would you like to share that video with us?" "Absolutely not. Plus your evidence of my crimes has completely biased your investigation."
Happens all the time in criminal law too, unfortunately. Any slight deviation from process and the defence will use it to case doubt on the continuity of the evidence gathered. They also try to highlight how it damages the credibility of the case.
The difference is they are under an obligation to fully co operate with the investigatory body unlike in a criminal case - see Suns (Chinese swimmer) 7 year ban from CAS for non co operation with doping officers .
I don't disagree. I am just saying that finding a technicality to get the case thrown out is very common.
oh don't get me wrong City will have teams of lawyers poring over the EUFA evidence looking for flaws just hope EUFA have done it by the book as they were determined top get City having been a) clearly misled by City b) The PSG fiasco & the embarassment that caused .
I think part of Citys argument is that the evidence they submitted wasn't even looked at and factored into the decision and that the outcome was decided before investigation complete. Didn't they mention in one of their statements about the decision being made solely on the hacked emails? Not sure how that ties up with their lack of cooperation but it's all conjecture at the moment. As you allude to in a later post I'm not sure I trust any of them.
Yeah he is a bad loser - like really bad He is only ever nice about a defeat when it suits but Fergie was a bad loser so is Pep (for me Pep is the worst because at least the other two were honest about their **** housry lol - Pep is just slimy) it has to be said Klopp is not the best when he loses but he is a level below those mentioned imho Suppose it’s a prerequisite for the job
