I try and see things from both sides to be honest, which is why I had a go at your original post as I felt that it was very much one-sided and giving no acknowledgment to the other side that she might have been taco discriminated against. Should I have called you a racist? No I shouldn’t. It was a reaction rather than considered reply.
As a serving police officer I see racism on a daily basis so I am very well attuned to it. I’m definitely not a bleeding heart liberal, although in some circumstances I firmly believe that the rights of the individual exceeds the rights of the state.
The thing is though there will always be racism. It will never go away.

    For pity's sake!

I doubt that she'd even completed her probationary period before she pulled 'a sickie'.

To me, she is just another worthless individual who has pulled the racist card because she realised she wasn't up to the job and wouldn't be confirmed.
Imho, it has existed since the beginning of time, with certain tribes considering themselves superior to others, and always will - it's ingrained in human nature!

Maybe not in such an overt way BUT the tendency for some individuals to look down on others will always exist.

What are you advocating as the next stage?

Anyone called a 'charver' should be able to sue for hurt feelings, resulting in damage to their mental health?

That would be the logical progression, if the demented are continually accommodated.

As the thread title said,"The world's gone mad"!!

I’ll give you the chance to read the tribunal’s findings before you comment any further. At least that way you can give us an informed opinion.

Well EJK I’ve taken the time to read 62 pages of this judgement and was for the most very hard going.
I must say that the lady concerned was, during her training bullied tirelessly by one compounded by a second person and NONE of the others tried to stop it.

However what really shocked me was the total incompetance of her training leader that compounded her humiliation.

Then the officers that then ‘investigated’ her complaint were (because senior status and thus training) were if anything were even more incompetent and totally lavked any insight to laws related.

Finally she was financially abused when delaying payment of wages due and later threatening her with court and bailiffs.

The DWP had proffessional representation -

    She represented herself. (WOW !)

And she won on ALL counts. Well done that lady it must have been a terrible, horrific ordeal but was totally vindicated, I for one wish her well.

people trying to see things from both sides....in my last job i was always talked down to (drivers are ten a penny/you only sit on your arse all day/many other such comments) i was told my route would be sunderland/durham area mainly with the odd jaunt into magland, turned out that i was sent all over the north east, cleveland and even trips to manchester, as i was the only driver at the start with 2 men inside taking orders and organising deliveries i figured when it went to SIX men inside taking orders and organising deliveries, plus with orders from head office to take any and all orders THEN locate the product if notin stock THEN promise the delivery in the next hour that they might possibly take on another driver or attempt to spread the load but nope, stuck with me alone....top this off with having to collect and carry dangerous loads (one man was decapitated when an exact same load shot off the top of a van and into his back window) that i was threatened with the sack if i refused to carry it.

finally, i cracked, and so followed years of shrinks and cpn visits, meds after meds after meds...i did go for unfair dismissal (things must have changed as at the time i was told the law was that you had to be employed for over 6 months to go for an unfair dismissal case) and i was told that due to a change in the law i could only claim up to a maximum of 6 months pay and i had put up with years of this crap because we all want to work...it was also the time when mobiles were coming more and more into use, i was told i HAD to answer ALL calls even if driving.

so there you have another side to a similar story...i will not go into detail or even guess why my 'payout' was 388k less than this ladies, you can all make your own minds up.

I'm sorry but my view hasn't changed.

I couldn't care less if she claimed that voodoo dolls had been given to her every day since she joined, or if someone dressed as a witch doctor and danced in front of her 3 times a day (neither of which did she claim, before anyone starts) being, allegedly, called a few names and made to feel uncomfortable does not entitle her to a £400,000 payout.

The head of the tribunal should, imho, be sacked and never allowed to officiate again.

He clearly doesn't live in the real world and has no regard for handing over other people's cash to an overly sensitive, workshy, wimp.

Fine, if that’s what you want to believe, then go ahead. I’m done with it.

OK! You'll disappear because you can't even attempt to justify the ridiculous amount awarded.

    C'est la vie!!

£400K is a lot of money but oftentimes these punishments are doled out (see what I did there!) as a means of warning others that their behaviour and actions will be dealt with equally as harshly and can act as a deterrent.

Sorry but hows that a deterrent ?
400k isn't a punishment, its an amount awarded to the claimant not a fine to the perpetrators.
If anything it encourages more to just down tools over the slightest remark and drag out court cases at the tax payers expense imo.
I haven't looked at the cost of this case but i assume it was substantial.

Was their a race case ?
Skim reading the minutes yes but but I'm wondering as there was an English employee who accepted comments aimed at her as banter.
Will she now seek a claim for £400k ?

I live and work in the real world and have witnessed far worse than this case, I've also witnessed some "ethnic minority" individuals going along with banter and giving it back.
I'm not condoning it I'm just pointing out that worse goes on and sometimes its not all nastiness and one sided.

There's people gone through a hell of a lot worse than this and got a tiny fraction of that amount even after many years of loyal service.

Anyway I've never understood office banter, bunch of self opinionated arsey fannies if yer ask me, should get out an do some proppa graft. :D

I see that the head of the tribunal wasn't a qualified judge/legal practitioner at all!

Laura Howden-Evans is a part time university lecturer at Swansea University’s School of Law.

Kenneth Clarke, who appointed her, needs his head examining!!

It also transpires that Anne Giwa-Amu joined DWP as an admin officer in February 2017 as the only non-white recruit of nine new trainees and the only one aged over 50, the tribunal heard. Within five weeks, she made a formal complaint of bullying and racial harassment and was signed off work sick suffering from stress and anxiety.

    Madness!
