So people think he should get locked up for driving a car while pissed?

Morally you might be right, but the system would be ****ed if everyone that got nicked for drink driving got locked up. Never going to happen. The 'he might have killed someone' argument is absolute nonsense too. You can't lock someone up for predicting what might happen.

Our prison system is so crowded it's a non starter.

Nowt to do with being pi55ed, he refused a breath test, that is why he was locked up, it carries a maximum 6 month prison sentence. Not our fault he's a nobhead.

    :)

You know it's true mate. It was always the main topic of discussion in a Mags Court. Praying you didn't have the arsehole that loved dishing out the cells or remembered you from previous.

Loads of things carry a 'maximum 6 months sentence' - it's very rare these get carried out. Our country isn't designed to lock people up for committing petty crimes.

You have sex offenders walking around that have to sign a register. Locking someone up for refusing to do a breathalyser is complete madness.

Being a "drunk driver" is a ****ish thing to do...end of.

People are killed and maimed on a daily basis by drink drivers.
It wrecks individual lives, destroys families, causes people huge problems including losing their jobs, it costs the NHS millions and is an act of utter selfishness.
So yeah...I do "have a bee in my bonnett" about ****s thinking they got a right to do it.
**** him...maybe it'll stop some one else from becoming a **** and save some one from being hurt or killed as a result.
He broke 2 laws...he drank while takjnv medication so was not in control of himself so was driving dangerously.
And he refused to do the test.

All you have done is play down the seriousness of his ****ish behaviour..."made someone break sharply" ffs... like I said... good missing the point <ok>

So what do you think the punishment should be?

Not sure anyone is suggesting he didn't do a ****ish thing tbh.

Unfortunately I've stood in front of plenty of mags, and they're a piece of piss to get on your side. If you're only in mag court you have an extremely easy task to get off with a fine or just a slap on the wrist.

  12. We don’t sentence people based on what they might do; we sentence them on what they do.

I get it that you have a particular grievance against people who drink and drive, but the standard punishment for these people is a ban and a fine.

Sending them to prison is reserved for the worst cases. Nothing in what Saunders is reported to have done appears to warrant the harsher sentence. It appears that he did nothing more than offend the judge with his arrogance.

    I don’t condone drink driving

Yeah right, most Mags have already worked out the sentence before you walk in and they see the appearance sheet. The conversation goes something like...ah so it's him again, Skylarker, I can remember when he last appeared, the smarmy prick, six months nailed on this time....and i'm going to watch him sweat before i pass the sentence.

Personally speaking...For the first offence would give someone the choice of:

    1) jail for a month and a year driving ban
    or
    2) 200 hours of community service with people hurt by drunk drivers do they learn empathy and the seriousness of driving under the influence and a 18 month ban.

I genuinely do not hnderstsnd why the law does not treat it with the seriousness it deserves unless someone is hurt as a result.

I do not drive and am amazed at how many drivers do not drive safely (not indicating, not seeing pedestrians on crossings, ignoring speed restrictions in residential areas and around schools etc but I get these can be mistakes, a lack of concentration etc but that is very different from choosing to drive after drinking (particularly while taking medication like Saunders did).

I find it hard to see the difference between choosing to drive a car over the limit and going out with a knife to be honest.

For a second offence there should be a compulsory 12 month sentence.

Not expecting anyone to agree by the way...cos you're all tossers...
