Seeing as you're the cleverest people I know. My son is a passenger in his girlfriend's car who stops at a red light and gets out and a cyclist had crashed into the car as he opened the door, the cyclist was going very fast. Small damage to the car and wheels of the bike . Who's gotta pay for what here?
His gf could try putting it through the insurance in some way. Depends if the cyclist is willing to support the claim, she's fully comp, how much damage there is and if it's more than any excess.
I think so too as he shouldn't be getting out at the lights regardless of the cyclist speed which is opinion.
I don't believe it comes under the highway code as he was the passenger, it's more a civil matter - damage to property. That's just my assumption I don't know how correct that is.
Was he hurtling towards a red light on the inside of a row of stationary cars then? Still culpable in my opinion.
That's a good point. I honestly don't know. I may be wrong but he couldn't claim against the gf's insurance because she wasn't at fault so fck knows. EDIT: Chief could be right.
I don't think a cyclist who is going down the inside of a row of stationary cars towards a red light at such a speed he cant stop has a leg to stand on, personally. Tell him it's knock for knock and to **** off, frankly.
