Fair point, and also if the lad is homesick there is a good chance he will jump at the chance to get back to Spain regardless of clauses etc and it is the players who make these decisions now a days not the clubs. I do think though surely Benitez can have a quiet word and say "look we all know Diame will revert to type this season, hes getting on now and you'll be back in the side before you know it, get your head down, work hard over preseason and you'll be playing in no time."
I think Mo will continue to well next season as long as he's playing DCM and not ACM/#10. He's very good at breaking up play and simple passes and that's really all he has to do in his revised role in the team. If he has to start attacking more he'll revert to type as he's not very good at it. Square peg in a square hole since he was moved to DCM.

It’s the club at fault for agreeing to it. In modern football 12m Euro is nowt. And the agents don’t have every right to leak it as most contracts have confidentiality clauses in so it’s likely they didn’t have a legal right to do so. NDA’s are also used quite a bit in these situations so if a contract doesn’t provide for confidentiality.... the original NDA/CDA would.
They clearly had plans for Merino requesting that release clause. Again it’s just agents ruining the game looking to move clients around regular earning their cut of the move. On Merinos part he will just want to play as he is spending too much time in crucial development years not playing. I would quite like to have seen him in a more advanced position like we saw for Spain u21. Be a shame to lose him but looks like out of our hands. The lad hasn’t said anything yet though has he?
At fault for agreeing it ? If the choice is getting a player you need with a proviso that you will only be able to make a £5 million profit on him or missing out on the player, getting the player seems the better option to me. You've got to remember that we are not that attractive an option at the moment and were even less so this time last year.

NDA means almost nothing to be honest. Yes it stops a player/agent openly coming out and admitting a clause but unless you can prove where the leak came from there's little can be done. If it exists and the agents want people to know about it then it will come out. I remember a Coventry striker back in 2000ish who had a release clause that was apparently confidential. Must have been down to Suarez not complaining. There was a Court case about this a few years back the gist of which was that once a release clause was met, the Club has no further part to play in the negotiations. it is strictly between the player and the buying club.

How is it the same with fans every year? No players have been bought yet so it's doom and gloom and we're getting relegated. Most transfers will go to close to the deadline, especially if they are players in demand. Save the moaning for the day after the deadline and maybe something will happen in the meantime.
