Perhaps. But in the case of the former colleague, he got an increased amount to cover moving expenses, break in career etc. I'm not sure, but I suspect that with no case proven, comments about guilt can be seen as evidence of defamation of character or what ever the term is.
Why do I get the feeling that this isn't the last we have heard of Bullard and his sacking. He has signed for Ipswich which means we must have released his registration. What impact or relevance does this have on his possible appeal. It's a shame we have had to release such a good player, but one who deserves all the criticism and flack from us supporters. I just hope he doesn't come back to haunt us when we play them at the KC! Here's hoping our owners let NP spend some of the money we have saved on two or three new players. We desparately need to strengthen our squad, striker, Midfielder, centre back and goalie all needed! Up the Tigers!!
For constructive dismissal he would have had to resign and then claim that his employers conduct was so bad that they effectively dismissed him. That's not the case here. MoH is correct about mitigation of loss, but a breach of contract claim in the High Court is more likely than a claim in the ET as he could recover more in damages (and his costs) in the High Court if he won. Defamation is a whole other minefield!!
APM, He would need to go through an ET (and EAT), in the first instance, as it is an employment matter. The main appellate courts in the civil justice system are the Divisional Courts (High Court). They deal with cases involving libel actions etc. MoH
AMP, Unfair dismissal = ET and/ or EAT. Wrongful dismissal = ET and/ or EAT. Could go through the civil division and probably would IF he takes this course of action due to the £25000 ceiling imposed on the ET/ EAT in this regard. It really depends on how he is advised. He's not slagging us at all(at least not in his first Ipswich interview), he's said he enjoyed being with us and we're a good club, but he can't discuss his exit as his lawyers have told him not to.
