    The heat of battle on a football pitch can make normally quiet rational people do things out of character, having said that, there is no excuse for racism.

    If Jay's being charged, I would guess that there was probably a witness or video evidence, the FA are unlikely to charge if it's a straight word against word.

    Precisely. Of course he's innocent until proven guilty but I would suspect they have a strong case if they've decided to charge him.

    I'd love to agree, but we seem to have moved to "the victim is always right" justice.

    Of course any claim of a racist remark should be investigated, but let's not presume that because the case is being investigated he has committed an offence. Until we hear the evidence we cannot assess the strength of the case. The authorities had to investigate. To do otherwise would bring a charge of ignoring racist behaviour, but let's not presume guilt.

    I said I suspect they have some form of what they consider strong evidence as they don't tend to hand out charges without it.

    Hopefully it was all a misunderstanding but I doubt we'll ever see/hear all of all the 'evidence' - as in the public.

    I would also add that if the FA find him guilty then it doesn't necessarily mean he is either... The FA aren't courts of law and can work on probability rather than 'beyond reasonable doubt'. See John Terry for example.

    That's if you trust our law courts of course ;)

    That's what I was thinking as well, they have already spent a few days "investigating" and have decided that Jay has a case to answer for.

    I hope that whatever the outcome, true justice is served for all parties concerned.

    My apologies, LL. I didn't intend to suggest you were lynch-mob happy! You are right,of course, in suggesting that there is sufficient merit in the claim for it to go to a hearing. There should be a hearing, of course. In general, however, there has always been a tendency for implied guilt when charges are bought, and this seems to be exacerbated in the social media circus. It was this I was taking a swipe at, not your perfectly reasonable assertion that the authorities consider that there is something worthy of investigation.

    The complainant must believe it or he wouldn't have persisted with it....after all he's not some random troublemaker who'd make it up.
    Jay is convinced he didn't say it. The possibilities include he was misheard or that he didn't see it as racist. Unless there was a witness close enough to hear it, I don't see how they can arrive at a decision.....it will come down on the side of probability....as this isn't a court of law where more proof is needed.

    I do feel that people can say things in anger without truly being racist. After all, in other circumstances he could have said, 'You Scotttish t**t'' without being someone who despised and loathed all Scots and thought they were inferior.

    In all honesty there lies the problem. Sometimes, being half Italian and half Indian, I can be a bit sensitive to things said - even if they are not meant. However, if J Rod said something that he didn't mean as racist and it was to the other guy (lol who's name I have forgotten), then maybe education is the answer, rather than punishment. Quite often people say things without thinking that maybe as they were growing up were acceptable, but aren't now.

    Has a video of the incident. Jay clearly says something but if you watch his reaction of when Bong is reporting it to the ref he clearly doesn’t think he has said something. You can see it in how his face changes when Bong’s talking to the ref. I would hope it is something miss heard like he said “get back you stink” and he has heard it as “you’re black and stink”.

    That gesture of waving his hand over his mouth that Jay makes suggests to me that he was making a comment about his breath.

    In face of claims that City are being 'butchered' by other teams, an interesting summary of fouls and cards in the EPL so far. City have been fouled less than West Ham and a lot of other teams, but their opponents get a lot of cards suggesting that their fouls are severe. No Saints player features in the 'most fouled' category, but then on the other hand opponents may think 'why bother'. :)
