Hearts, Hibs, Aberdeen, Dundee Utd have already stated they will be voting "NO" and I would have thought Celtic will ay no too! They will have no players, a transfer embargo, and probably start life in whatever league they get thrown into on -15 points!!
TC, It's unlikely that Celtic will vote against Rangers. They rely on each other too much. If there's money in Scottish football, it's when those 2 are involved in the same thing. If the other teams in Scotland play hardball, there's every chance that clubs will be bought in england & renamed. Already rumours flying about re. Bury & Pompey takeovers by them. Also, there will be no transfer embargo. Court threw it out in Scotland. Not entirely sure about the -15 points either. I thought that was for clubs in administration. This will be a newco - nothing to do with the liquidated old club, legally.
Employment law would support the employee in the case of refusing a TUPE, in fact it is my understanding that the player could become creditors of the old company in lieu of redundancy payoff? Symantec Limited v Leddy and Symantec Limited v Lyons, High Court, May 28 2009. Found that employees were not eligible for redundancy when refusing a TUPE, however the right of an employee to object to being transferred for cause in circumstances where the transfer involves a substantial change in working conditions to his or her detriment could still allow a redundancy claim (eg, relegation could be claimed that it is a substantial change in working conditions) Anyway I doubt Charles Green or the newco (Sevco 5088) could afford to take anyone to court & should be happy to get the wage bill down. It is looking like they have just spent 5.5million on a Third division club that can not use the name Rangers Football Club & have less players than Peterhead... I don't see a long drawn out legal battle, FIFA are Newco's only hope of help but this could lead to a Bosman style case coming to a head.
Disagree. There's a whole lot more commercial awareness in the fans than you give them credit for. With their hearts they'd vote against, but not with their heads. They'd be next to go bust without the money Rangers generate.
Not sure if TUPE applies here as it's not an outsourcing agreement or takeover/divestment - it's a liquidation. There is no right to transfer to newco, nor is there an obligation to, hence newco has asked the players to sign for them.
The Celtic supporters club have said that if they are allowed back in to the SPL they will boycott every away match next season at every ground !!! The fact remains they need 7 yes votes to get back in to the SPL !!!! personally I hope they get them as it would weaken the SPL even more than it already is.
Why boycott away games? If they really want to punish the club, then surely you'd boycott the home games...
Looking at the message boards north of the border, they seem to think Celtic will vote no, but only because they think there's enough other clubs who'll vote yes for it not to matter.

I found it strange aswell when Green started talking about TUPE. It just doesn't seem to fit. I can understand him being a bit miffed if players could just walk away when a transfer fee would ordinarily be payable, but then again the players took a 75% cut (according to them) in their wages to keep Rangers going. This may be a naive question as I do not know the ins and outs of what it really was that Rangers did, but: - wasn't it the players who were getting a lot of benefit from the dodgy deals? - Ergo, is HMRC going after any individual players or their agents?
Sounds like the players were being paid illegally by the club - not their fault. Assuming Rangers are made to start in Div 3, who should get the extra SPL place? Dunfermline (Relegated SPL) or Dundee (Second place in Div 1) I personally think a one-off Playoff between the two is the fairest course of action.... Any one got an opinion?
Think there is a precedent for this sort of thing. Happened when Livingstone got dropped down a couple of leagues, but I suppose that was Scottish League, not SPL.
