    Sorry this has jack **** to do with football but I could do with some advice. I've looked all over the web but can't find anything.

    I've been offered another job which starts next week so I need to hand my notice in tomorrow BUT my employers are twats and I'll most likely lose all my commission for this month if they know I'm leaving as commission is paid at their discretion.

    I get paid on friday and I got my payslip yesterday confirming my bumper pay, question is, can they take that off me if I hand my notice in tomorrow? I want to leave on good terms so would like to avoid just quitting as soon as I'm paid!

    I could be wrong but as you have received your payslip there is nothing they can do but pay you what you are owed

    hand your notice in after you check that youve been paid on friday. once the money is in, they cant do anything.

    Pay slip says what you are owed, they cant then not pay you that surely?

    As your solicitor, i would advise you that your payslip constitutes a legally binding contract, hence they can deduct the pay if necessary. They technically own you, so there isn't much you can do to argue.

    Only once the money is in your account is it safe.

    The only way to reclaim any monies paid is to sue - I don't think they'll do that somehow.

    They might actually, as it constitutes lost revenue, while it may be a small amount, the breach of contract means they could ramp up the funds that they may sue for.

    Looks like I'll have to wait til I'm paid then do one I guess, to be safe at least, cheers folks.

    Are you in a Union? Is there no works representative there that can speak for you?

    Pretty poor company though if they don't pay you what they owe you, they won't come out of it smelling of roses.

    Call the CAB or ACAS. They might be able to point you in the right direction.

    If you've earned the commission and you have a payslip to prove it...i can't see how they can take it away from you, but i think i'd go for the safe option and get the money first.

    This, but also depends on what contract you are on, and what length of notice you have to give to leave. With most people it is at least a month. If you don't give that month's notice they can legally ask you to return your pay, but I don't think that includes your bonus (unless, again, your contract states bonus is dependent on length of time at employer, etc.).
