The FA statement - 'Sergio Aguero has been charged for an alleged act of violent conduct which was not seen by the match officials but caught on video. The Manchester City forward was involved in an incident with West Ham United’s Winston Reid in the 76th minute of the game on Sunday [28 August 2016]. He has until 6pm on Wednesday 31 August to reply. Off the ball incidents which are not seen at the time by the match officials are referred to a panel of three former elite match officials. Each panel member will review the video footage independently of one another to determine whether they consider it a sending-off offence. For retrospective action to be taken, and an FA charge to follow, the decision of the panel must be unanimous.'
Just out of interest, the three 'elite' match officials who deliberated on Aguero's case were Howard Webb, Howard Webb jnr and Howard Webb II.

Really surprised about this, I just couldn't see it happening especially since the ref that didn't see it was looking straight at them at the time.
I personally don't think they would miss him that much. They have very good frontline players that can hurt any team regardless of Aguero's presence. City's strength is really in midfield and wings and most strikers will feed off that.
Ref was probably watching the ball and looking ahead for a foul on the receiving player. I've done that before when reffing games. You see the pass being made and immediately shift your focus to where it's going so you are ready for a player to get clattered as the pass comes in. You don't look for something that happens just after the ball has gone. Of course the alternative explanation is that the ref did actually see it, but couldn't admit that in his report as he would basically be admitting he saw and failed to punish violent conduct, and would thus be relegated to the Championship for a few weeks.
