    The whole drunk thing is stupid. She was aware enough to know where she was, where she was going, who she was with etc. She would have been fully able to consent.

    Also if she was too drunk to consent then most people on here have committed rape

    Dear me this thread demonstrates how little most people know about how rape is defined under the sexual offences act 2003
    At this moment in time evans has had his conviction quashed and awaits a new trial at which the evidence which was apparently not placed before the original jury will now form part of the re trial
    Speculation supposition and completely misinformed comments here will not change a thing if he is found guilty he will go down if he isn't he will be released that's all we need to say I'm afraid
    Best not to post stuff suggesting lots of people on here have had non consensual sex with inebriated women I think

    What if both parties are drunk? Does that mean they both raped each other?

    How many of us have got drunk and done fun stuff and appear quite in control.
    And then the next day not remember a thing. Or just bits.

    This memory loss should not be used as a gauge to how drunk you were.
    Just because you cant remember DOES NOT mean you were that drunk you were incapable of making decisions.
    And usually its the last drink or two that magnify the memory loss, and these last drinks usually start to take effect well after you have drank them, usually while you are asleep.
    Drugs can act the same.
    Obis reasoning is simply wrong, equating memory loss the next day to the inability to make decisions the night before.

    How drunk would you have to be to filmed lying on the floor in the street, wet the bed and lose your memory?

    The woman couldn't remember having sex with MacDonald either and the jury found him, quite correctly, not guilty. Nothing wrong with my reasoning. The woman's memory didn't convict Evans I'd say it was the evidence and actions of MacDonald that did that.

    Was this before after or during said rape? The only footage I saw was her putting pizza boxes down on the floor in the hotel foyer looking sober as a judge.
    And again Obi (YOU ARE NOT LISTENING) failing to recall the previous nights events is not a gauge as to how drunk you were.
    Did she wet the bed ejaculating?
    I'm sure I read there were drugs in her system. Something she denied?
    She may have been of sound mind when sex was occurring and some other substances during or after tipped her over the edge.
    Do you know the facts? You seem to be pretty convinced.

    Doesn't matter whether she had drugs in her system or not. She never said she was raped. She said she couldn't remember having sex either with MacDonald or Evans. In court she didn't deny she had given consent, she said she couldn't remember.

    Nobody knows what state she was in other than Evans and MacDonald, everything else is guesswork. There's press reports of what both said in court on the internet somewhere. I can't remember where but some of them are fairly verbatim.

    She was filmed sprawled on the floor before she met MacDonald, which was before she got to the hotel with the pizza boxes.

    On the evidence presented in court I'd have voted to convict.

    At 02:54 the 19-year-old woman sends a coherent text message, which is spelt and capitalised correctly and then pays for a kebab that she has ordered with the correct coinage.



    and Evans was seen leaving the hotel by fire escape 2 hours later.

    By the time they get to the hotel it is approaching 4.15am and the hotel porter hears the lady request Clayton not to leave her – saying: “you’re not going to leave me are you?”. They entered the room and eventually engaged in sexual intercourse.

    does this sound like a woman too drunk to make decisions?

    Everyone is equating "not being able to remember giving consent" to being raped
    When it simply is not.
    Has anyone wondered if, even in these morally bereft times, she may have simply been defending her honour by saying I can't remember and I must have been spiked?

    That evidence was presented to the court. The jury said yes. Same with the text.
