IF, MASSIVE IF, Jimmy has done it again then it should be the last and final straw and gives HULL CITY the ability to terminate Bullards silly contract at long last. lets face it, in the real world he would have been sacked a long time ago. My hope is that the day is very close to an end and JB leaves WITH NOTHING.
If the club could "sack" him for this then they would. The truth is he could probably argue it only deserved a warning. I don't suppose specific types of incident are listed in a footballers contract. This would mean it would probably come down to arguing how serious an offence the incident was.
From what we know, and there seems to be much that is unclear, there would appear to be sufficient disciplinary breaches to sack him. There must surely be disciplinary clauses in his contract. I don't know why they don't just sack him and let him sue the club for wrongful dismissal - if he can!
If we think we can sack him for this, I have absolutely no doubt we will, but in itself it's probably not enough. That said, this isn't the first time, he was sent home from the Cottingham training ground over a year ago for arriving pissed. He was also warned about his conduct after getting in bother down Prinny Ave with Ash and Cooper(the main reason Ash left). Collectively, that should be enough. Thing is he isn't a student though is he. You and I can get away with going to a morning lecture with a kicking hangover but Jimmy is working professional and in the big wide world of work it isn't seen as banter. I wouldn't turn up to a job 'in an unacceptable state' as i would expect consequences for my actions, be that not getting my wages for a week or 2 or even the sack. I don't know enough about Jimmy''s actions to know if it deserves to be a sackable offence but in one way or the other it needs to be shown to the younger players and the team as a whole that this behaviour isn't tolerated. I'll stand by the club with whatever the decision they make, if Jimmy stays however he will be skating on thin ice with the club and if he truly wants to stay and fight for his place then he needs to ****ing well show it!
As a student of Human Resource Management I can inform you, that JB cannot be sacked for being drunk at the work place unless they have given him official written warnings in the past. The only time the employer has a leg to stand on if you have not had a written warning in the past is if you are "putting your colleagues in SERIOUS danger" you could argue I suppose that he was more likely to injure a team mate? But this does not suggest SERIOUS threat to their life however it is going to put them out of work I suppose? The only other time it is deemed a sackable offence is if you are in control of a vehicle as you are putting the public in danger. Jimmy can be fined given official written warnings but it is near on impossible to sack him for this. If you dont believe me or dont want to, check out the CIPD website, thats like our bible.
I disagreed with this as i know where i worked if you turned up to work, you where considered incapable of performing the work you was given and therefore that is a sackable offence surely? If people want to sack you they will always find a way to sack you, end of story. We have enough on Jimmy to sack him surely, i think OLM alone has enough to get Jimmy sacked. However how do you get to prove that? Thats the hard thing, hard facts, most of it is what has being told to NP and AP. Anyway i feel he should, there is no chance he will play for us again after this, anyone who thinks he will is lying to themselves. Lets plan for life without Jimmy, we have Koren who is a professional and tbh still a class act to.
They cannot sack you for it. Do the research there are numerous articles out there were someone has taken it to court. Unless you have been given previous written warnings about you conduct and this was the straw that broke the camel’s back it’s not a sackable offence. They will send you home with a warning if you are incapable to work but cant sack you. The only other way you can be sacked for turning up drunk is if you had to read and sign a company 'Alcohol and Drugs Policy' when you first started at a company and this is states that your contract will become null and void. If you didn’t have to sign one then the employment law does not cover sacking on these grounds.
Obviously you know far more about it than me, but i suppose the position that i have seen them getting sacked for is the fact that he was putting other people in Serious danger.... makes sense....
i doubt he'll be sacked as just as other posters have commented, in itself this is not a sackable offence even if morally he should be binned off. totally unnacceptable for a highly paid professional sportsman who "just wants to play football" to behave in such a manner. banter?!?!?!?!?! shaving foam in boots, hiding clothes, comedy flyers with a doctored pic on every car windscreen at the training ground, having a laugh on the training pitch is absolutely no issue but do NOT turn up half cut after a bender. slovenia or hull, doesnt matter. i feel duped and stupid cause i too like many others (and more who wont admit it) were drawn in to the the idea of him working hard in training, building some bridges with NP and featuring heavily in a really successful season. at least now the allams, who strike me as decent moral people, know what kind of attitude and behaviour they can expect from their highest paid player. this might not give us a legal right for dismissal, the question is does this make his future at hull city untenable? for me.......its a yes!
